CC Resolution No. 179346 RESOLUTION NO. 1793 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THE RESULTS OF THE REGULAR ELECTION HELD WITHIN THE CORPORATE LIMITS OF THE CITY OF BAYTOWN, TEXAS, ON THE 13TH DAY OF MAY, 2006, FOR THE PURPOSE OF ELECTING THE MAYOR AND THREE COUNCILMEMBERS FROM DISTRICT NOS. FOUR, FIVE AND SIX; FINDING THAT NOTICE OF SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on February 9, 2006, the City Council of the City of Baytown ordered the regular municipal election of the City of Baytown to be held between the hours of seven o'clock a.m. and seven o'clock p.m. on May 13, 2006, in the City of Baytown, Texas, for the purpose of electing the following members of the City Council: Mayor Council Member from District No. Four; Council Member from District No. Five; and Council Member from District No. Six (the "Regular Election "); and WHEREAS, on May 13, 2006, the Regular Election was held under and pursuant to the provisions of the Charter of the City and all laws concerning the same; and WHEREAS, pursuant to Chapter 67 of the Texas Election Code, the Council of the City of Baytown, Texas, at a meeting held on the 22nd day of May, 2006, canvassed the returns of the Regular Election as required by law; and WHEREAS, the City Council further finds that the total votes cast by resident, qualified electors of the City of Baytown at the Regular Election were as follows, to -wit: FOR MAYOR Robert Gouner 394 Stephen H. DonCarlos 1895 FOR COUNCIL MEMBER DISTRICT NO. 4 Don Murray 346 Coil FOR COUNCIL MEMBER DISTRICT NO. 5 Ronnie Anderson 393 Lynn A. Caskey, II 400 FOR COUNCIL MEMBER DISTRICT NO. 6 Sammy Mahan 288 WHEREAS, the City Council finds the election returns set out above to be accurate and correct and no election protest or contest have been filed with the City of Baytown or instituted in connection with said election returns; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby finds that the above - referenced recitals are true and correct. Section 2: That City Council of the City of Baytown, Texas, further finds that the notice of the Regular Election and Special Election were duly and properly given as required by law and as provided in the ordinances calling the elections and that the elections were duly and regularly held and the returns thereof duly and regularly made by the proper officials of said elections and in all things according to law. Section 3: That the City Council of the City of Baytown, Texas, after the returns of the results of the election were made and delivered, canvassed such returns all in accordance with law and the ordinances calling the elections. Section 4: That Stephen H. DonCarlos received a majority of the votes cast at the Regular Election for the office of Mayor of the City of Baytown and accordingly, Stephen H. DonCarlos is hereby declared elected to the office of Mayor of the City of Baytown. Section 5: That Don Murray received a majority of the votes cast at the Election for the office of Council Member from District No. 4, and accordingly, Don Murray is hereby declared elected to the office of Council Member from District No. 4. Section 6: That Lynn A. Caskey, II, received a majority of the votes cast at the Election for the office of Council Member from District No. 5, and accordingly, Lynn A. Caskey, II, is hereby declared elected to the office of Council Member from District No. 5. M Section 7: That Sammy Mahan received a majority of the votes cast at the Election for the office of Council Member from District No. 6, and accordingly, Sammy Mahan is hereby declared elected to the office of Council Member from District No. 6. Section 8: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown, Texas.
