RESOLUTION NO. 1713
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
APPROVING A PORT OF HOUSTON, 3.2 ACRE MITIGATION PROJECT IN THE
BAYTOWN NATURE CENTER; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.

WHEREAS, the Port of Houston Authority's Barbours Cut Terminal has experienced shoreline
erosion along the Houston Ship Channel; and
WHEREAS, in order to commence shoreline protection construction activities, the Port of
Houston Authority (the "Authority") is required to obtain a U.S. Army Corps of Engineers Section 404
Individual Permit, which requires that mitigation be performed to compensate for affects to wetlands
where the shoreline stabilization will occur; and
WHEREAS, to mitigate these wetland losses, the Authority has agreed to provide funding for the
construction of 3.2 acres of saline marsh and has selected the Baytown Nature Center as the project site;
and
WHEREAS, the Friends of the Baytown Nature Center has agreed to administer such funds and
to employ Crouch Environmental Services, Inc.,to perform the planned construction; and
WHEREAS, the Parks and Recreation Advisory Board has reviewed and approved the
Authority's mitigation project; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown hereby approves a Port of Houston,
3.2 acre mitigation project in the Baytown Nature Center, as further depicted in Exhibit "A," which is
attached hereto and incorporated herein for all intents and purposes.
Section 2: This resolution shall take effect immediately from and after its passage by the
City Council of the City of Baytown, Texas.
INTRODUCED, READ and PASSED, by the affirmative vote of the City Council of the City of
Baytown this the 12'h day of May, 2005.
