RESOLUTION NO.1693
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE EMPLOYMENT OF A CASE MANAGER TO
PROVIDE SERVICES IN CASES INVOLVING JUVENILE OFFENDERS
AND TO ASSIST IN THE COMPREHENSIVE PLAN TO REDUCE
JUVENILE CRIMES WITHIN THE CITY; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, Article 45.056 of the Texas Code of Criminal Procedure provides that on
approval of the city council, a municipal court may employ a case manager to provide services in
cases involving juvenile offenders before the court consistent with the court's statutory powers;
and
WHEREAS, Article 45.056 of the Texas Code of Criminal Procedure also authorizes the
City to apply to the Criminal Justice Division of the Governor's Office for reimbursement of all
or part of the costs of employing the juvenile case manager by presenting to the Governor's
Office a comprehensive plan to reduce juvenile crimes in the City that addresses the role of the
case manager in that effort; and
WHEREAS, Section 51.08(d) of the Texas Family Code states that a court that has
implemented a juvenile case manager program under Article 45.054 of the Texas Code of
Criminal Procedure, may, but is not required to, waive its original jurisdiction under Section
51.08 (b)(1) of the Texas Family Code; and
WHEREAS, the City Council herein finds it in the public interest to designate ajuvenile
case manager for the purpose of allowing the Municipal Court to process and handle cases
involving juveniles with more than two criminal convictions; and
WHEREAS, the City Council wishes to employ a case manager in accordance with
Article 45.056 of the Texas Code of Criminal Procedure and to be eligible for the costs of
employing such individual; and
WHEREEAS, the City Council herein designates the municipal court clerk performing
the duties on the juvenile desk as the juvenile case manager for the City of Baytown; NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: The City Council authorizes the employment of a case manager in
accordance with Article 45.056 of the Texas Code of Criminal Procedure and designates the
municipal court clerk performing the duties on the juvenile desk as the juvenile case manager for
the City of Baytown.

Section 2: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown, Texas.
