CC Resolution No. 1661 53 RESOLUTION NO. 1661 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING THE DATE, TIME AND PLACE FOR A PUBLIC HEARING TO DISCUSS THE IMPOSITION OF THE IMPACT FEE AND THE PROPOSED ORDINANCE IMPOSING SUCH FEE IN THE CITY OF BAYTOWN AND ITS EXTRATERRITORIAL JURISDICTION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The City Council of the City of Baytown, Texas, hereby establishes August 12, 2004, as the date for a public hearing to discuss the imposition of the impact fee and the proposed ordinance imposing such fee in the City of Baytown and its extraterritorial jurisdiction. Such public hearing will be held at 6:40 p.m. in the City Council Chamber of the City of Baytown, 2401 Market Street, Baytown, Texas. Section 2: The City Clerk of the City of Baytown is hereby authorized and directed to cause notice of the public hearing to be published in a newspaper having general circulation in each county in which the City of Baytown is located before the 301h day before the date set for the hearing. The notice must contain: (1) a headline to read as follows: NOTICE OF PUBLIC HEARING ON ADOPTION OF IMPACT FEES (2) the time, date, and location of the hearing; (3) a statement that the purpose of the hearing is to consider the adoption of an impact fee; (4) The amount of the proposed impact fee per service unit; and (5) a statement that any member of the public has the right to appear at the hearing and present evidence for or against the plan and the proposed fee. Section 3: The City Clerk of the City of Baytown is hereby authorized and directed to cause notice of the public hearing to be sent to any person who has given written notice by certified or registered mail to the City Clerk requesting notice of the hearing within two years preceding the date of this resolution. Section 4: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. 54 INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown this the 81h day of July, 2004.
