CC Resolution No. 1591 39 RESOLUTION NO. 1591 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PROVIDING FOR THE CONSIDERATION OF A TAX INCREMENT REINVESTMENT ZONE ALONG TRI-CITIES BEACH ROAD, BAYTOWN, HARRIS COUNTY, TEXAS, FOR THE ISLAND PARK PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, it may be in the public interest to consider promoting the development and redevelopment of certain property in the City of Baytown by creating a reinvestment zone pursuant to the Tax Increment Financing Act, Chapter 311 of the Texas Tax Code; and WHEREAS, it is desirable to consider impacts on all affected property owners and of other taxing jurisdictions which levy real property taxes within the proposed reinvestment zone regarding the establishment of the zone; and WHEREAS,it is necessary to adopt written guidelines for Tax Increment Reinvestment Zone eligibility and creation; and WHEREAS,other preliminary procedural steps and due diligence must be completed prior to any further action related to establishment of the zone; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby desires to consider the creation of a Tax Increment Reinvestment Zone(the"Zone")on Tri-Cities Beach Road based upon preliminary information provided by the developer of property to be included in the Zone. Section 2: That the City Council of the City of Baytown, Texas, is in conceptual agreement with establishing such Zone for the Island Park project based upon the representation of the developer to: - address infrastructure code and condition issues within the currently developed section of the proposed Zone; - take steps necessary to address blight and to visually enhance the area; - ensure that development of the property would not negatively affect the existing water and sewer infrastructure of the City; - create a future development agreement to address impacts on City services, including, but not limited to, police, fire and emergency medical services; - be responsible for up-front consulting expenses for establishing the Zone; and - take steps necessary to address traffic impact and ingress/egress issues. Section 3: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. 40 INTRODUCED,READ and PASSED,by the affirmative vote of the City Council of the City of Baytown this the 26`s day of June, 2003.
