CC Resolution No. 1576 18 RESOLUTION NO. 1576 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REQUESTING THE SHERIFF OR CONSTABLE TO SELL THE PROPERTIES LOCATED AT 5903 DECKER DRIVE AND 611 MAYO, BAYTOWN, HARRIS COUNTY, TEXAS, AT A PUBLIC SALE PURSUANT TO SECTION 34.05 (C) OF THE TEXAS TAX CODE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown desires to return deteriorated or unproductive properties to the tax rolls, to enhance the value of ownership to the properties neighboring those which have been bid off to the City of Baytown in tax foreclosure sales, and to improve the safety and quality of life throughout the City; and WHEREAS, in light of such goals, the City Council finds that it is in the best interest of the City of Baytown to sell via public sale the following properties: Property Le-al NUniberand Date of Tax Address Description Style Of Suit Sale Tract2B,Block 27 Cause No. 1988-17149; City of 4/6/93 5903 Decker Drive (016*PT LT 2), Baytown v. Texas Oil and Gas Highland Farms Corp.; In the 55 Judicial District Court,Harris County,Texas Cause No. 1990-47328; City of 611 Mayo South 50 feet of Lot 3, Baytown v. Merced Arthur Oviedo; 8/3/93 Lee Heights In the 157 Judicial District Court, Harris County,Texas (the "Properties"); and WHEREAS, the City acknowledges that at such public sale, the acceptance of a bid by the officer conducting the sale is conclusive and binding on the question of its sufficiency; and WHEREAS, the right of redemption on the Properties has expired prior to the date of this resolution; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the findings of the City Council of the City of Baytown contained in the recitals of this resolution are hereby approved and adopted. Section 2: That pursuant to Section 34.05 (c) of the Texas Tax Code, the City Council of the City of Baytown requests the Sheriff or Constable to sell the Properties at a public 19 sale in the manner prescribed by the Rules of Civil Procedure for the sale of property under execution. Section 3: That the City Manager is hereby authorized and directed to submit this resolution to the Sheriff or Constable and to receive any bid accepted by the officer conducting the public sale of the Properties. Section 4: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
