CC Resolution No. 1558 46 RESOLUTION NO. 1558 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY OF BAYTOWN TO CONTACT AND COORDINATE WITH THE TEXAS DEPARTMENT OF TRANSPORTATION, THE CITY OF HOUSTON AND THE BAYTOWN LOCAL EMERGENCY PLANNING COMMITTEE REGARDING POTENTIALLY PROHIBITING THE OPERATION OF LARGE TRUCKS IN THE LEFT LANE OF STATE HIGHWAY 146 BETWEEN THE SOUTH CITY LIMITS AND BUSINESS 146 - ALEXANDER DRIVE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, pursuant to Section 545.0651 of the Texas Transportation Code the City of Baytown by ordinance may restrict, by class of vehicle, through traffic to two designated lanes of a highway in the municipality; and WHEREAS, such ordinance must be in effect only during peak traffic hours of a workday and allow a restricted vehicle to use any lane of the highway to pass another vehicle and to enter and exit the highway; and WHEREAS, in evaluating whether to establish such an ordinance, the City of Baytown is required to contact and coordinate with the Texas Department of Transportation (the "Department") and the City of Houston, and may contact and coordinate with the Baytown Local Emergency Planning Committee; and WHEREAS, before adopting such an ordinance, the City of Baytown is required to hold a public hearing and to submit to the Department the following: ➢ copies of the proposed ordinance; ➢ documentation demonstrating compliance with state law; ➢ plan views of the roadway and a complete description of the proposed restriction; ➢ a signature of approval of the request; and ➢ a written transcript of any public comments received concerning the proposed ordinance; and WHEREAS, in order to enforce such restriction, the Executive Director of the Department must approve the restriction based on a traffic study performed by the Department to evaluate the effect of the proposed restriction and on a systems approach to preclude the designation of inconsistent lane restrictions among adjacent cities; and WHEREAS, if approved, the Department will erect and maintain official traffic control devices necessary to implement and enforce the City's ordinance; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: 47 Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the City of Baytown to contact and coordinate with the Texas Department of Transportation, the City of Houston, and the Baytown Local Emergency Planning Committee regarding potentially prohibiting the operation of large trucks in the left lane of State Highway 146 between the south City limits and Business 146 - Alexander Drive. Section 2: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
