CC Resolution No. 1556 43 RESOLUTION NO. 1556 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CONTINUATION OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT SALES AND USE TAX THROUGH DECEMBER 31,2003;AUTHORIZING THE CITY MANAGER TO NOTIFY THE TEXAS COMPTROLLER OF PUBLIC ACCOUNTS OF THE CONTINUATION OF THE SALES AND USE TAX; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on February 2, 2002,the Baytown Crime Control and Prevention District(the "District")held a special election regarding the continuation of the District and the associated sales tax; and WHEREAS,a majority of the votes cast at the such election were not in favor of continuing the District for 10 years nor continuing the Crime Control and Prevention District sales tax for 10 years; and WHEREAS, due to the results of the election, the District was dissolved pursuant to the Crime Control and Prevention District Act (the "Act") on August 2, 2002; and WHEREAS,the City has assumed the outstanding short-term and long-term liabilities of the District totaling $4,482,172.50; and WHEREAS,because the revenue from the District's sales and use tax is needed to retire the liabilities of the District that that were assumed,the City desires to continue collecting the District's sales and use tax through December 31, 2003, pursuant to the Act;NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the continuation of the Baytown Crime Control and Prevention District's sales and use tax through December 31,2003,since the revenue from such tax is needed to retire the liabilities ofthe Baytown Crime Control and Prevention District that were assumed by the City of Baytown. Section 2: That the City Manager is hereby authorized and ordered to notify the Texas Comptroller of Public Accounts of the continuation of the sales and use tax authorized in Section 1 hereof on or before the I" day of November, 2002. Section 3: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. 44 INTRODUCED,READ and PASSED by the affirmative vote of the City Council of the City of Baytown, Texas, this the 12th day of September, 2002.
