CC Resolution No. 1545 28 RESOLUTION NO. 1545 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,APPROVING THE BAYTOWN NATURE CENTER PARK RULES AND OPERATIONS PLAN;PROVIDING A REPEALING CLAUSE;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section l: That the City Council of the City of Baytown, Texas, hereby adopts the Baytown Nature Center Park Rules and Operations Plan. The rules and operation plan are attached hereto as Exhibit "A" and incorporated herein for all intents and purposes. Section 2: All resolutions or parts thereof inconsistent with the terms of this resolution are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this resolution shall be cumulative of other ordinances and resolutions regulating and governing the subject matter covered by this ordinance. Section 3: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. R_ Hours of Operation Recommendation: Opening and closing hours will be posted at gate. Will reflect opening 30 minutes before sunrise and closing 30 minutes after sunset hours will change monthly. BNC is to be open everyday of the year, except during extreme . inclement weather. Existing Ordinance:All municipal parks,when posted,except the Gray Sports Complex,shall be closed to the public daily between 1 o:00 p.m.and 5:00 a.m. Fishing Recommendation: No fishing in natural areas or fresh water pond and only during posted hours of operation. Motor vehicle operation Recommendation: Existing ordinance OK as is,but a speed limit should apply. 20 mph is recommended. Existing Ordinance: It shall be unlawful for any person to drive, propel or park any motor vehicle over,through or on any park,other than along or upon public streets or designated park drives and parking spaces and parking areas, except by permit. vehicle Operation Recommendation: No vehicles of any kind, including bicycles,without a permit from Director of Parks and Recreation are allowed in natural areas. Outside of natural areas,bicycles must stay on trails and roads. Speed Limit Recommendation: Speed limit of 20 mph throughout BNC. 41 Riding horses Recommendation: Existing ordinance OK as is. Existing Ordinance: It shall be unlawful for any person,other than a peace officer while conducting official city business,to ride any horse or other animal or animal-drawn vehicle over or through any park, except in areas or on paths or trails so designated. Golf Recommendation: No golfing in any form should be allowed. Existing Ordinance: It shall be unlawful for any person within any public park, parkway, playground or any other public place for public recreation to hit golf balls, except floating-type practice balls that are incapable of doing injury to persons or objects. Shooting Arrows Recommendation: Existing ordinance OK as is. Existing Ordinance: it shall be unlawful for any person to shoot any arrow on or over any park. Fireworks or Firearms Recommendation: Existing ordinance OK as is. Existing Ordinance: It shall be unlawful for any person to carry or discharge any firearm, firecracker, rocket, torpedo or any other firework, air gun, BB gun or slingshot on or over any park. Dogs • Recommendation: no pets,including dogs, should be allowed in the BNC. City ordinance allowing "support dog guiding or otherwise aiding a totally or partially blind or otherwise incapacitated person while such person is in such park"is OK as is. Existing Ordinance: It shall be unlawful for any person to permit any dog owned or possessed by him to run at large or permit any such dog in a park unless it shall at all times be kept on a leash. No dog shall be permitted, in any manner whatsoever, in any park in the proximity of any athletics/sports facilities during practice sessions or league or tournament activities.Additionally, no dog shall be permitted, in any manner whatsoever, in designated fish and wildlife refuge areas of the Baytown Nature Center. Subsection (a)of this section shall have no application to-a support dog guiding or otherwise aiding a totally or partially blind or otherwise incapacitated person while such person is in such park. Alcoholic Beverages Recommendation: Existing ordinance OK as is. Existing Ordinance: It shall be unlawful for any person to possess or consume alcohols beverages in city parks except at Bayland Park, and there only at times and under conditions and requirements designated by the director of parks and recreation in consultation with the city manager and other city staff. Glass Containers Recommendation: Existing ordinance OK as is. Existing Ordinance: It shall be unlawful for any person within any public park, parkway, playground or any other public place for public recreation to possess glass containers. Litter , Recommendation: Existing ordinance OK as is. • , Existing Ordinance: It shall be unlawful for any person within any public park, parkway, playground or any other public place for public recreation to dump,deposit or leave any litter, including but not limited to paper boxes, cans, rubbish, waste,garbage, refuse, brush,leaves, tires or any other trash. Camping Recommendation: Existing ordinance OK as is. Existing Ordinance: It shall be unlawful for any person to camp overnight in any park,except by permit. Fires Recommendation: No fires are to be allowed in BNC, except for vegetation dontrol as authorized by both Director of Parks and Recreation Department and Baytown Fire Chief, and except for special events by reservation as authorized by Parks and Recreation Director. Existing Ordinance: it shall be unlawful for any person to start or maintain, in any park,any outdoor fire, other than a cooking fire that is started and maintained only in a stove or barbecue pit, except by permit. Models Cars or Airplanes Recommendation: No model cars, boats, or airplanes or any remote-controlled devices allowed in the BNC. Existing Ordinance: It shall be unlawful for any person to operate motor-driven model cars or airplanes on or over park drives or parking areas. • Sales of Merchandise Recommendation: Existing ordinance OK as is. Existing Ordinance: It shall be unlawful for any person to merchandise, advertise or post signs announcing or calling the public's attention to articles or services for sale or hire in any city park, unless done pursuant to a permit. Signs or Decorations Recommendation: Existing ordinance OK as is. Existing Ordinance: It shall be unlawful for any person within any public park, parkway, playground or any other public place for public recreation to tack or otherwise place any sign, placard, inscription or decoration on any tree, building, equipment or facility, unless done pursuant to a permit. Collecting of Natural Objects Recommendation: No collecting of natural objects including wood, plants, shells, flowers, etc. Swimming Recommendation: No Swimming at BNC. Boating Recommendation: No boating including canoeing and kayaking in the BNC.
