CC Resolution No. 1526 2853 RESOLUTION NO. 1526 A RESOLUTION AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN, TEXAS, TO APPLY FOR A GRANT TO THE OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION, TEXAS NARCOTIC CONTROL PROGRAM IN CONNECTION WITH THE HARRIS COUNTY ORGANIZED CRIME AND NARCOTICS TASK FORCE; AUTHORIZING THE REPRESENTATIVE TO ACCEPT OR AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM; AUTHORIZING THE CITY'S PORTION OF THE MATCH FUNDS, WHICH TOTALS ONE MILLION TWO HUNDRED THIRTEEN THOUSAND FOUR HUNDRED NINETY-FOUR AND NO/100 DOLLARS ($1,213,494.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City Council of the City of Baytown finds it in the best interest of the citizens of Baytown that the Harris County Organized Crime and Narcotics Task Force ("HCOCNTF") be operated for the 131h year; and WHEREAS, the City Council of the City of Baytown has considered the proposed application for state and federal assistance for HCOCNTF, in the amount of THREE MILLION SIX HUNDRED FORTY THOUSAND FOUR HUNDRED EIGHTY-ONE AND NO/100 DOLLARS ($3,640,481.00), to be submitted to the Texas Narcotic Control Program, Office of the Governor, Criminal Justice Division; and WHEREAS, the City of Baytown will receive a maximum of THREE MILLION SIX HUNDRED FORTY THOUSAND FOUR HUNDRED EIGHTY-ONE AND NO/100 DOLLARS ($3,640,481.00) in Criminal Division Funds for the HCOCNTF; and WHEREAS, the total matching funds required under this grant is ONE MILLION TWO HUNDRED THIRTEEN THOUSAND FOUR HUNDRED NINETY-FOUR AND NO/100 DOLLARS ($1,213,494.00) as required in the grant application— EIGHTY-FIVE THOUSAND SIX HUNDRED SIXTEEN AND NO/100 DOLLARS ($85,616.00) being the City of Baytown's portion for its personnel costs and the remaining funds being supplied from member agencies and generated program income; and WHEREAS, the City Council has agreed that in the event of loss or misuse of the THREE MILLION SIX HUNDRED FORTY THOUSAND FOUR HUNDRED EIGHTY-ONE AND NO/100 DOLLARS ($3,640,481.00) in the Criminal Justice Division Funds, the City of Baytown assures that the funds will be returned to the Criminal Justice Division in full; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true, and are approved as such by the City Council of the City of Baytown. 2854 Section 2: That the City Council of the City of Baytown hereby approves submission of the grant application for the HCOCNTF to the Office of the Governor, Criminal Justice Division, Texas Narcotic Control Program in the amount of THREE MILLION SIX HUNDRED FORTY THOUSAND FOUR HUNDRED EIGHTY-ONE AND NO/100 DOLLARS ($3,640,481.00). Section 3: That the City Manager of the City of Baytown is hereby designated as the authorized representative for all purposes under the grant. Section 4: That the City Manager of the City of Baytown is hereby authorized to accept or affirm any grant award that may result from the above application. Section 5: That the City of Baytown's portion of the required matching funds, totaling ONE MILLION TWO HUNDRED THIRTEEN THOUSAND FOUR HUNDRED NINETY-FOUR AND NO/100 DOLLARS ($1,213,494.00), is hereby authorized in the amount of EIGHTY-FIVE THOUSAND SIX HUNDRED SIXTEEN AND NO/100 DOLLARS ($85,616.00). The remainder of such match will come from member agencies and generated program income. Section 6: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
