RESOLUTION NO. 1451
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, REPEALING RESOLUTION NO. 1193 CONCERNING THE CITY'S
PURCHASING PROCEDURE PASSED ON OCTOBER 28, 1993; ELECTING
TO HAVE CHAPTER 252 "PURCHASING AND CONTRACTING
AUTHORITY OF MUNICIPALITIES" OF THE TEXAS LOCAL
GOVERNMENT CODE TO SUPERSEDE ARTICLE VII "FINANCE /
ADMINISTRATION," SECTION 74 "PURCHASING PROCEDURE" OF THE
CHARTER OF THE CITY OF BAYTOWN, TEXAS; AND PROVIDING FOR
THE EFFECTIVE DATE THEREOF.
WHEREAS, Chapter 252 of the Local Government Code establishes the purchasing and
contracting authority for certain municipalities; and
WHEREAS, Section 252.002 of such code generally provides that any charter provision
of a home-rule municipality that relates to the purchasing procedure of such municipality that is
in conflict with Chapter 252 of the Texas Local Government Code shall control unless the
governing body of the municipality elects to have Chapter 252 supersede the charter;
WHEREAS, on October 28, 1993, the City Council of the City of Baytown made such an
election for expenditures for insurance of more than $5,000 and for all other expenditures of
more than $10,000; and
WHEREAS, the City Council of the City of Baytown now desires and herein elects to
adopt the purchasing procedure established in Chapter 252 of the Texas Local Government Code
to supersede the purchasing procedure established in the Charter of the City of Baytown, without
the above-referenced limitations; and
WHEREAS, the City Council herein finds that such election is consistent with the City's
commitment to providing opportunities for competition before making any purchase or contract
for supplies, materials, equipment or contractual services and is in accordance with Chapter 252
of the Texas Local Government Code; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby declares that
the above-referenced recitals are true and correct findings of the City Council of the City of
Baytown, Texas.
Section 2: That the City Council of the City of Baytown, Texas, hereby repeals
Resolution No. 1193 concerning the City's purchasing procedure for expenditures for insurance
of more than $5,000 and for all other expenditures of more than $10,000, passed on October 28,
1993.

Section 3: That the City Council of the City of Baytown, Texas, hereby elects to have
Chapter 252 "Purchasing and Contracting Authority of Municipalities" of the Texas Local
Government Code, as hereinafter amended, supersede Article VII "Finance Administration,"
Section 74 "Purchasing Procedure" of the Charter of the City of Baytown, Texas.
Section 4: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown, Texas.
