RESOLUTION NO. 1398
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, APPROVING THE SALE BY SEALED BIDS OF PROPERTIES
PREVIOUSLY FORECLOSED ON BY THE CITY OF BAYTOWN DUE TO
DELINQUENT AD VALOREM TAXES; APPROVING AS AUTHORIZED
ALL PREVIOUS ACTIONS TAKEN BY THE CITY OF BAYTOWN
CONCERNING THE FORECLOSURE OF THE CITY'S TAX LIENS ON
THESE PROPERTIES AND THE CONVEYANCE OF THESE PROPERTIES
TO THE HIGHEST BIDDERS; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the following properties in the City of Baytown were the subject of
delinquent tax lawsuits:

WHEREAS, judgments and decrees of sale were rendered in these lawsuits in favor of
the City of Baytown, Goose Creek Consolidated Independent School District and Lee College
District, and the State of Texas and County of Harris; and
WHEREAS, as a result of orders of sale issued on the judgments and decrees of sale,
these certain properties were struck off to the City of Baytown for the use and benefit of itself
and the Goose Creek Consolidated Independent School District and Lee College District, and the
State of Texas and County of Harris; and
WHEREAS, by deeds recorded in the deed records of Harris County, Texas, these certain
properties were transferred to the City of Baytown, the Goose Creek Consolidated Independent
School District and Lee College District, and the State of Texas and County of Harris; and
WHEREAS, pursuant to Section 34.05 of the Property Tax Code of the State of Texas,
the above- described properties were awarded to the best and highest bidders at a public sale held
on March 28, 1996; and
WHEREAS, before the sale of the above- described properties to the best and highest
bidders can be consummated by the various governmental entities, it has been determined that
the City of Baytown must by resolution approve and authorize the foreclosure of its tax liens on
these properties, and furthermore must confirm and approve the March 28, 1996, public sale by
sealed bids; NOW THEREFORE

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council hereby confirms, approves and authorizes all actions
taken by the City Administration in initiating lawsuits to collect the delinquent taxes that had
accrued against the above- described properties and the foreclosure of said liens on these
properties pursuant to the judgments that were obtained in the above - described lawsuits.
Section 2: That the City Council of the City of Baytown hereby further authorizes,
approves and confirms that the City Administration's actions in advertising the above- described
properties for sale by public auction and/or sealed bids, the holding of a sealed bid sale of the
above- described properties and all other acts taken by the City Administration necessary to
conduct a public auction or sale by bids for delinquent tax properties that was held on March 28,
1996.
Section 3: That the City Council of the City of Baytown hereby authorizes, approves
and confirms that the highest and best bidders for the properties, should be conveyed all of the
City's rights and interests in the above - described properties, subject to the approval of deeds
conveying said properties, by all the governmental entities with interest in the properties.
Section 4: This resolution shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the
City of Baytown this the 12'h day of August, 1999.
