RESOLUTION NO. 1355
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO ACQUIRE, IMPROVE AND
MAINTAIN CERTAIN DEDICATED DRAINAGE EASEMENTS; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, conditions exist within the City of Baytown whereby storm drainage from developed
areas is collected in a system that then discharges into natural or man -made ditches located on private
properties; and
WHEREAS, the provision of adequate drainage is a service the City of Baytown desires to maintain
in order to provide for the health and safety of the residents; and
WHEREAS, the City of Baytown must have a right of access to the private properties in order to
maintain outfall structures to ensure adequate drainage structure maintenance; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the Director
of Public Works or his designee to acquire through dedications drainage easements along the outfall routes,
through which storm water discharges.
Section 2: That the Director of Public Works is authorized to provide all labor and materials
necessary to appropriately pipe ditches located within dedicated drainage easements on platted, single -
family, residential lots and thereafter maintain such pipe structures. Additionally, the Director of Public
Works is authorized to provide certain ditch improvements and maintenance services on certain property,
not classified as platted, single - family, residential lots, if the owner of such property dedicates a drainage
easement to the City and supplies the City with adequate pipe.
Section 3: This resolution shall take effect immediately from and after its passage by the City
Council of the City of Baytown, Texas.
INTRODUCED, READ and PASSED, by the affirmative vote of the City Council of the City of
