CC Resolution No. 1346 2572 RESOLUTION NO. 1346 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING HARRIS COUNTY TO PLACE SECTIONS OF BAYWAY DRIVE, TRI-CITIES BEACH ROAD AND EAST TEXAS AVENUE ON THE HARRIS COUNTY ROAD LOG; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown anticipates entering into an agreement with Harris County for construction and engineering services necessary to repair portions of the following streets: (i) Bayway Drive (West Baker Road to Park Street); (ii) Tri-Cities Beach Road (East Texas Avenue to a point 200 feet south of Evergreen Road); and (iii) East Texas Avenue (1000 feet on each side of the intersection of East Texas Avenue and Tri-Cities Beach Road), hereinafter collectively referred to as "Streets;" and WHEREAS, Harris County desires to obtain access to said streets for the purpose of obtaining Preliminary Phase Engineering Services to determine the cost associated with the repair of the Streets prior to entering into an agreement with the City of Baytown; and WHEREAS, Harris County desires to place the Streets in the County Road Log for the limited purpose of obtaining a Preliminary Phase Engineering Study; and WHEREAS, the City of Baytown is willing to allow Harris County to place said portions of the Streets on Harris County's Road Log for this purpose; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: That Harris County is authorized to place the following on the Harris County Road Log for the limited purpose of conducting a Preliminary Phase Engineering Study: (i) Bayway Drive from West Baker Road to Park Street (ii) Tri-Cities Beach Road from East Texas Avenue to a point 200 feet south of Evergreen Road (iii) East Texas Avenue 1000 feet on each side of the intersection of East Texas and Tri-Cities Beach Road Section 2: That during the time that the sections of the above-referenced streets are on the Harris County Road Log for the purpose of conducting a Preliminary Phase Engineering Study, the City of Baytown will continue to have maintenance responsibility for such sections. Section 3: That during the time that the sections of the above-referenced streets are on the Harris County Road Log, representatives of Harris County and their agents shall have access 2573 to the rights-of-way of these streets for the purpose of conducting a Preliminary Phase Engineering Study. Section 4: This Resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
