RESOLUTION NO. 1309
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,AND
THE CITY OF BAYTOWN'S PARKS AND RECREATION ADVISORY BOARD
SUPPORTING ACTION BY THE SEVENTY-FIFTH LEGISLATURE OF THE STATE OF
TEXAS TO TRANSFER THE LICENSING AND REGULATORY RESPONSIBILITY OF
PESTICIDE APPLICATION AND RIGHT-OF-WAY VEGETATION MANAGEMENT
WITHIN URBAN AREAS TO THE TEXAS DEPARTMENT OF AGRICULTURE;
ENDORSING H.B. 3115; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS,trees, shrubs, grass, other horticultural plants and right-of-way vegetation management
are commonly considered agriculturally-related; and
WHEREAS, the Texas Structural Pest Control Board Law is generally structured towards the
licensing and regulation of persons and firms commercially engaged in the "for profit" enterprise of pesticide
applications within buildings and structures; and
WHEREAS, the Texas Structural Pest Control Board is primarily engaged in licensing and
regulatory issues; and
WHEREAS,the Texas Department of Agriculture is a division of the State Government, charged with
oversight and development of all venues of agriculture within the State; and
WHEREAS, the Texas Department of Agriculture has a working relationship for technical and
academic resources with the Texas Agricultural Extension Service,which is represented in two hundred fifty-
three (253) counties within the State and has a strong program of training and research; and
WHEREAS,the Texas Department of Agriculture currently licenses and regulates the application of
pesticides for farmers,ranchers, forest managers, grain and seed warehouse operators, and rural right-of-way
managers, as well as various other pesticide applications; and
WHEREAS, State Representative Robert Gutierrez of District 41 has introduced legislation
transferring the licensing and regulatory responsibility of pesticide application on trees, shrubs, grass, and
other horticultural plants and right-of-way vegetation management within urban areas and by employees of
political subdivisions from the Texas Structural Pest Control Board to the Texas Department of Agriculture;
NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS AND THE
CITY OF BAYTOWN'S PARKS AND RECREATION ADVISORY BOARD:
Section 1: That the City Council of the City of Baytown and the City of Baytown's Parks and
Recreation Advisory Board hereby endorse and encourage action by the Seventy-fifth Texas Legislature to
transfer the licensing and regulatory responsibility of pesticide application on trees, shrubs, grass and other

horticultural plants and right-of-way vegetation management within urban areas and by employees of political
subdivisions from the Texas Structural Pest Control Board to the Texas Department of Agriculture.
Section 2: That the City Council of the City of Baytown and the City of Baytown's Parks and
Recreation Advisory Board hereby specifically endorse H.B. 3115 by Representative Gutierrez.
Section 3: That the City Council of the City of Baytown and the City of Baytown's Parks and
Recreation Advisory Board believe this action by the Texas Legislature will be most beneficial to all residents
of Texas.
Section 4: This resolution shall take effect immediately from and after its passage by the City
Council of the City of Baytown and the City of Baytown's Parks and Recreation Advisory Board.
