RESOLUTION NO. 1269
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, TO SUPPORT CONSIDERATION BY THE TEXAS MUNICIPAL
LEAGUE TO INTRODUCE LEGISLATION REQUIRING ALLOCATION OF A
PORTION OF THE STATE GASOLINE TAX TO MUNICIPALITIES TO
PROVIDE FUNDING ASSISTANCE FOR INFRASTRUCTURE MAINTENANCE
ASSOCIATED WITH LOCAL STREETS AND ROADWAYS;AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, municipalities throughout the State of Texas continue to experience
deteriorating streets and roadways, and repair and replacement costs severely strain local resources;
and
WHEREAS,the State of Texas provides no funding for repair of local roadways which are
used by all citizens regardless of residency; and
WHEREAS, cities of Texas are denied use of the most relevant user tax, which is the
gasoline tax, and instead have to rely on the debt authority, both principle and interest, that voters
give the cities; and
WHEREAS, citizens of every community pay gasoline sales tax to the state, which is
intended to defray costs of construction and maintenance of roadways throughout Texas; and
WHEREAS, the legislature has authorized counties throughout Texas to collect additional
motor vehicle registration fees to fund road and bridge repair throughout counties; and
WHEREAS, as a matter of equity and fairness municipalities throughout Texas should
receive a share of gasoline sales tax to maintain efficient mobility and transportation systems within
the community; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section 1: The Texas Municipal League is respectfully urged to consider inclusion in the
legislative package for the 75th Session of the Texas Legislature appropriate legislation to provide
allocation of a portion of the gasoline sales tax to municipalities for local street and road repair.
Section 2: The Texas Municipal League is also respectfully requested to urge consideration
of sharing of any gasoline taxes collected by the State with municipalities during any interim study
committees authorized by State Officials addressing revenue and/or other such topics prior to the
next Legislative session.
Section 3: Copies of this resolution shall be forwarded to appropriate state elected officials
and the Resolutions Committee of the Texas Municipal League.

Section 4: This resolution shall take effect immediately from and after its passage by the
City Council of the City of Baytown.
INTRODUCED,READ and PASSED by the affirmative vote of the City Council of the City
