CC Resolution No. 1245 2400 RESOLUTION NO. 1245 A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION AND SPECIAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 6TH OF MAY, 1995, FOR THE PURPOSE OF ELECTING THREE COUNCILMEMBERS FROM THE RESPECTIVE THREE DISTRICTS 1, 2 AND 3 ; AND FOR THE PURPOSE OF CONSIDERING THE PROPOSED PROPOSITION AS TO THE NEIGHBORHOOD PROTECTION ORDINANCE; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, pursuant to Chapter 67 of the Texas Election Code, the City Council of said City, at a regular council meeting held on the llth day of May, 1995, proceeded, as required by law, to canvass the returns of the Regular and Special Municipal Election held in the City of Baytown on the 6th day of May, 1995 , for the purpose of electing three councilmembers from the respective three districts 1, 2 , and 3 and for the purpose of considering the proposed proposition as to the Neighborhood Protection Ordinance; said Elections having been held under and pursuant to the provisions of the Charter of said City and an Ordinance duly passed on the 12th day of January, 1995, calling said Elections; and WHEREAS, said elections having been duly and regularly had and held as called for in said Ordinance and according to law, and the returns thereof having been duly made and the Election Judges having certified the results of said Elections, as hereinafter set out, and the City Council having duly and regularly canvassed the returns of said Elections and finding that the total votes cast at said Elections were as follows, to-wit : FOR COUNCILMAN DISTRICT NO. 1 Eva Benavides 122 votes FOR COUNCILMAN DISTRICT NO. 2 David Elmore, Sr. 109 votes Rocky Rodriguez 34 votes Rolland J. Pruett 186 votes FOR COUNCILMAN DISTRICT NO. 3 Ron Priddy 370 votes Manuel Escontrias 455 votes 2401 PROPOSITION NO. ONE Should the City Council of the City of Baytown, Texas, adopt the proposed Baytown Neighborhood Protection Ordinance (text only) dated September 22 , 1994 , and proposed Baytown Zoning Maps Atlas dated December 31, 1994? FOR 1838 AGAINST 1409 AND WHEREAS, the City Council of the City of Baytown finds the Election returns set out above to be accurate and correct and no Election protest or contest having been filed with said Council or instituted in connection with said Election returns; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS : Section 1 : That Eva Benavides received a majority of the votes cast at said Election for the office of Councilman from District No. 1, and accordingly, the said Eva Benavides is hereby declared elected to the office of Councilman from District No . 1 . Section 2 : That Rolland J. Pruett received a majority of the votes cast at said Election for the office of Councilman from District No. 2 , and accordingly, the said Rolland J. Pruett is hereby declared elected to the office of Councilman from District No. 2 . Section 3 : That Manuel Escontrias received a majority of the votes cast at said Election for the office of Councilman from District No. 3 , and accordingly, the said Manuel Escontrias is hereby declared elected to the office of Councilman from District No. 3 . Section 4 : That Proposition No . One received a majority of the votes cast at said election for said Proposition. Section 5 : That the City Council of the City of Baytown further finds that the notice of said Elections were duly and properly given as required by law and as provided in the Ordinance calling said Elections and that said Elections were duly and regularly held and the returns thereof duly and regularly made by the proper officials of said Elections and in all things according to law. Section 6 : This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. 2 2402 INTRODUCED, READ and PASSED by the affirmative vote of the City Council of the City of Baytown, this the 11th day of May, 1995 . ��&C ews.Au PETE C.
