CC Resolution No. 1237 2386 RESOLUTION NO. 1237 A RESOLUTION AMENDING RESOLUTION 1146 , THE FORMAL AFFIRMATIVE ACTION PROGRAM, WHICH WAS PASSED AND ADOPTED ON APRIL 23 , 1992 , TO REVISE ARTICLE V "REPORTING, " IN ORDER TO MAKE THE CITY' S REPORTING REQUIREMENTS CONSISTENT WITH THOSE OF THE ECONOMIC DEVELOPMENT ADMINISTRATION; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS : Section 1 : That Article V "Reporting" of Resolution 1146 is hereby amended to read as follows : V. Reporting This Affirmative Action Plan will be updated on an annual basis containing the following components : 1 . Policies for implementation, 2 . Identification of Potential Problem Areas, 3 . Action-Oriented Programs/Good Faith Efforts, 4 . Workforce Analysis, 5 . Job Category Analysis, 6 . Availability Analysis, and 7 . Underutilization Analysis . Progress reports on all attainment of affirmative action goals will be done as an ongoing process with an annual formal presentation to the City Council . An ongoing analysis will be made of the specific processes utilized for implementation to determine the effectiveness of the total program and current year' s program. The Director of Human Resources or his/her designee will monitor all records of placements, referrals, transfers, promotions, and terminations of all levels to insure compliance . Periodic meetings with the City Manager, Administrative Directors and Department/Division Directors will be held to review progress and implementation of additional action-oriented programs . 2387 Section 2 : All resolutions or parts of resolutions inconsistent with the terms of this resolution are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this resolution shall be cumulative of other resolutions regulating and governing the subject matter covered by this resolution. Section 3 : If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this resolution or the application of same to any person or the set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this resolution or their application to other persons or sets of circumstances and to this end all provisions of this resolution are declared to be severable . Section 4 : This resolution shall take effect immediately from and after its passage by the City Council .
