CC Resolution No. 1220 2357 RESOLUTION NO. 1220 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DIRECTING TCI CABLEVISION OF TEXAS, INC. TO KEEP ACCURATE ACCOUNTS OF ALL AMOUNTS RECEIVED BY REASON OF THE PROPOSED BASIC SERVICE TIER RATES; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, TCI Cablevision of Texas, Inc. ("TCI") has a franchise agreement with the City of Baytown for the purpose of receiving, sending, amplifying, and distributing radio and television signals by cable to television sets to customers in that portion of Harris County, Texas, which falls within the city limits of the City of Baytown; and WHEREAS, on January 27, 1994, the City of Baytown in Ordinance No. 6909 adopted regulations regarding rates charged by cable companies to subscribers for the basic service tier; and WHEREAS, TCI submitted a benchmark analysis for its basic programming services to justify its basic cable rates based upon the Federal Communications Commission' s ("FCC") reasonable rate standard; and WHEREAS, Council in Resolution 1215 invoked an additional ninety (90) days in order to make a final determination regarding the reasonableness of the basic cable rates submitted by TCI; WHEREAS, Council held a public hearing regarding TCI 's basic cable rate submission on August 25, 1994 , pursuant to Ordinance No. 6909; WHEREAS, to date, Council has been unable to make a final determination regarding the reasonableness of TCI ' s submitted rates; and WHEREAS, this accounting order will reserve Council ' s authority to order refunds; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: TCI is hereby ordered to keep accurate account of all amounts received by reason of the proposed basic service tier rates and on whose behalf the amounts are paid; and Section 2 : This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. 2358 INTRODUCED, READ, and PASSED, by the affirmative vote of the City Council of the City of Baytown this the 8th day of September, 1994 .
