CC Resolution No. 1218 2352 RESOLUTION NO. 1218 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING APPLICATION TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE 1994-1995 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS; DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING REPRESENTATIVE TO ACCEPT OR AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ******************************************************************* WHEREAS, the 1994-1995 Community Development Block Grant Funds are sources of federal revenue that are made available to local Community Development Programs for use in reconstructing streets and drainage facilities and for the rehabilitation of owner occupied homes, and providing transportation; and WHEREAS, the Baytown Community Development Program is eligible for such funds and desires to apply for a grant; and WHEREAS, the Community Development Advisory Committee and City Administration have made recommendations as to the amounts and types of funds for which the local program should apply, such recommendations being known as the Community Development Block Grant Final Statement of Objectives and Projected Use of Funds, attached as Exhibit "A" and being made a part hereof for all intents and purposes; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The City Council hereby approves the Community Development Block Grant Final Statement of Objectives and Projected Use of Funds and authorizes the Community Development Program to make application to the United States Department of Housing and Urban Development for 1994-1995 Community Development Block Grant Funds as described in Exhibit "A. " Section 2 : That the City Manager is hereby designated as the authorized representative for all purposes under the grant. Section 3 : That the City Manager of the City of Baytown is hereby authorized to accept or affirm any grant award that may result from the above application. Section 4 : This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown. The City is eligible to receive 1994-95 CDBG funds in the amount of $1, 114, 000 . Additionally, the City anticipates receiving approximately $40, 000 in Community Development Program Income from various sources including the CDBG Small Business Revolving Loan Fund Program, Demolition/Clearance Program and Housing Rehabilitation. Program income from Demolition/Clearance includes payment of liens placed on structures demolished with CDBG funds and demolition permit fees collected. The City could receive program income through the Housing Rehabilitation Program from liens placed on projects rehabilitated with CDBG funds, to date no program income has been realized through this program. The City will budget these funds back into their respective programs for continuation of the programs . The City is reprogramming $118, 510 from previous CDBG Program Years and the projected total available for the 1994-95 CDBG Program Year is $1, 272 , 510 . NATIONAL OBJECTIVES By statue, CDBG funds must be used to accomplish one of the three following National Objectives : * Principally benefit low to moderate income persons (80% of less of the median family income as established by HUD) . * Aid in the prevention or elimination of slum or blighting conditions . * Meet a urgent City health or safety need. In addition, not less than 70% of the aggregate funding must be used to benefit low-moderate income persons . COMMUNITY DEVELOPMENT OBJECTIVES FISCAL YEAR 1994 Utilizing information gathered from public hearings and other sources, it has been determined that the prioritized community development needs in Baytown are: 1 . Rehabilitation of structures to provide decent, safe and sanitary housing for persons of low and moderate income. 2 . Encourage homeownership for moderate income persons by providing down payment/closing cost assistance in the form of forgivable loans . 3 . Provide funds for Public Service activities to enhance the health, public safety and quality of life of low and moderate income persons . 4 . Provide funds for Demolition and Clearance to address slum and blight . 5 . Provide funds for Code Enforcement activities in CDBG target areas . 6 . Improve public facilities in the CDBG target areas . 7 . Provide funds for Planning and Capacity Building activities in designated enterprise zone located in the CDBG target areas . 8 . Provide sufficient funds for the administration and management of the Community Development Program. Proposed Projects for the 1994-95 CDBG Final Statement of Objectives and Projected Use of Funds (B-94-MC-48-0033) PROGRAM ADMINISTRATION $149,350 For the administrative costs of operating the Community Development program. Includes costs for salary plus benefits of Community Development Planner, full time clerk and 25% of Assistant Planner to assist with data collection for HUD reporting. Office supplies, equipment and maintenance, furniture, and costs related with education and training. The $149, 350 represents 13 .4%� of the total budget . HUD regulations require that the administrative costs be less than 200 of the total budget . HOUSING REHABILITATION $410,109 This is the total costs of operating the housing rehabilitation program. Costs include salary plus benefits, education/training and travel expenses for one full-time Housing Rehabilitation Specialist and one full - time Assistant Planner for Housing. $131, 909 Will also allow for the rehabilitation of 13 structures at an average cost of $21,400 per structure . $278, 200 DEMOLITION OF STRUCTURES $160, 639 This is half the total salary plus benefits for one full-time Urban Rehabilitation Specialist to work on demolition projects . $18, 989 This also allows for the abatement of lead based paint prior to demolition of structures to comply with federal regulations . At this time it is not known when we will be required to start lead based paint abatement or the number of projects that will be affected. This also contains funding for the demolition and removal of approximately 30 dilapidated structures . $141, 650 CODE ENFORCEMENT/PLANNING AND $31,766 COMMUNITY DEVELOPMENT DEPARTMENT Includes half of total salary and benefits for urban rehabilitation personnel and 25%- of Assistant Planner to assist with care of premises and signs in CDBG target areas . Also includes travel and reimbursables and association dues for code enforcement personnel . CODE ENFORCEMENT/HEALTH DEPARTMENT $82,500 A. ) Funds to be used for one time clean-up of heavily overgrown properties in the C.D. Target Area. This one time clean-up would restore the properties to a maintainable condition. $20, 000 B. ) Funds to be used for initial clean-up and yard work for low income and elderly households in the C.D. Target Area. These persons are unable to maintain there own yards . $12 , 500 C. ) Funds to be used to clean platted, unmaintained alleyways/easements in the Pelly, West Baytown, Middletown and Airhart Neighborhoods . $50, 000 PUBLIC SERVICES $173, 100 A. ) Youth Activities Program - Funds to be used to fund activities in conjunction with the Youth Commission Coordinator position funded by the City. $10, 000 B. ) Adult Literacy Programs - Funds to be used for the Program Coordination ($26, 100) and Families Learning Together Activity ($25, 000) and the two activities are implemented out of the Sterling Public Library. The additional funding will increase the existing level of service. $51, 100 C. ) Increase Law Enforcement - Funds to be used to pay the straight time portion of salaries for police officers for additional patrols in connection with crime prevention program known as Operation Valdez . $12, 000 D. ) Senior Citizen Taxi Program - Funds to be used to continue the transportation program for senior citizens . The program provides eight (6) one-way rides per month throughout the city to approximately six hundred and fifty (650) residents of Baytown. $90, 000 E. ) Low Income Transportation Program - Funds to be used to provide transportation to low income residents to locations within the city limits and to social service agencies / health care facilities in Houston (within 610 Loop) , Pasadena and Channelview. $10, 000 ECONOMIC DEVELOPMENT $47, 546 A. ) Economic Development Loans - Funds to be used to provide additional capital for loans to small business to facilitate the creation of jobs for low to moderate income residents . Residential Street Improvements in the $194,600 C.D. Target Area. Funds to be used to rehabilitate streets, along with associated water/sewer line replacement, listed on the prioritized Street Improvement Program for the C. D. Target Area. Also funds will be used to install traffic control road humps in the C.D. Target Area. C. Rehabilitation of a Public Facility $50, 000 Funds to be used to rehabilitate the old Horace Mann Junior High School so that it can be utilized as a Neighborhood/Community Center. The Center will serve several neighborhoods in the C.D. Target Area. SOCIAL SERVICE FACILITY REHABILITATION $27, 900 , A. Baytown Housing Authority- Fund to be used to rehabilitate a total of ten (10) units at the Sam Houston and Lincoln Courts Housing Complexes . Rehabilitated units to be used as emergency shelter for the homeless and will be operated by the Housing Authority. TOTAL $1,372, 510 * Note: The amount allocated exceeds the amount available in order to avoid having to amend the 1994-95 CDBG Program should any of the projects prove to be unfeasible. This format has been recommended by HUD to avoid program delays . COMMUNITY DEVELOPMENT BLOCK GRANT GRANTEE CERTIFICATIONS In accordance with the Housing and Community Development Act of 1974, as amended, and with 24 CFR 570.303 of the Community Development Block Grant regulations, the grantee certifies that: (a) It possesses legal authority to make a grant submission and to execute a community development and housing program; (b) Its governing body has duly adopted or passed as an official act a resolution, motion or similar action authorizing the grantee to submit the final statement and amendments thereto and all understandings and assurance contained therein, and directing and authorizing the person identified as the official representative of the grantee to act in connections with the submission of the final statement and to provide such additional information as may be required; (c) Prior to submission of its final statement to HUD, the grantee has: 1. Met the citizen participation requirements of 5570 .301 (b) ; 2 . Prepared its final statement of community development objectives and projected use of funds in accordance with 5570 .301 (c) and made the final statement available to the public; (d) It is following a detailed citizen participation plan which: 1. Provides for and encourages citizen participation, with particular emphasis on participation' by persons of low and moderate income who are residents of slum and blighted areas and of areas in which funds are proposed to be used, and provides for participation of residents in low and moderate income neighborhoods as defined by the local jurisdiction; 2 . Provides citizens with reasonable and timely access to local meetings, information, and records relating to the grantee' s proposed use of funds, as required by the regulations of the Secretary, and relating to the actual use of funds under the Act; 9/92 i 3 , Provides for technical assistance to groups representative of persons of low and moderate income that request such assistance in developing proposals with the level and type of assistance to be determined by the grantee; 4 . Provides for public hearings to obtain citizen views and to respond to proposals and questions at all stages of the community development program, including at least the development of needs, the review of proposed activities, and review of program performance, which hearings shall be held after adequate notice, at times and locations convenient to potential of potential or actual beneficiaries, and with accommodation for the handicapped; 5 , provides for a timely written answer to written complaints and grievances, within 15 working days where practicable; and 6 . Identifies. how the needs of non-English speaking residents will be met in the case of public hearings where a significant number of non-English speaking can be reasonably expected to participate; (e) The grant will be conducted and administered in compliance with: 1. Title VI of the Civil Rights Act of 1964 (Public Law 88- 352, 42U.S.C. 5200d et sea. ) ; and 2 . The Fair Housing Act (42 U.S.C. 3601-20) ; (f) It will affirmatively further fair housing; (g) It has developed its final statement of projected use of funds so as to give maximum feasible priority to activities which benefit. low and moderate income families or aid in the ion of slums or blight; ot prevention or eliminat ' include statement of projected use of funds may activities which the grantee certifies are designed to meet other community development needs having a particular urgency because existing conditions pose a serious and immediate threat to the health or welfare of the community, and other financial resources are not available) ; except that the aggregate use of CDBG funds received under section 106 of the Act, and if applicable, under section 108 of the Act, during program year(s) 199 4 , (a period specified by the grantee consisting of one, two, or three specific consecutive program years) , shall principally benefit persons of low and 9/92 moderate income in a manner that ensures that not less than 70 percent of such funds are used for activities that benefit such persons during such period; (h) It has developed a community development plan, for the period specified in paragraph (g) above, that identifies community development and housing needs and specifies both short and long-term community development objectives that have been developed in accordance with the primary objective and requirements of the Act; (i) It is following a current comprehensive housing affordability strategy (CHAS) which has been approved by HUD pursuant to §570.306 and Part 91, and that any housing activities to be assisted with CDBG funds will be consistent with the CHAS; (j) It will not attempt to recover any capital costs of public improvements assisted in whole or in part with funds provided under section 106 of the Act or with amounts resulting from a guarantee under section 108 of the Act by assessing any amount against properties owned and occupied by persons of low and moderate income, including any fee charged or assessment made as a condition of obtaining access to such public improvements, unless: 1. Funds received under section of 106 of the Act are used to pay the proportion of such fee or assessment that relates to the capital costs of such public improvements that are financed from revenue sources other than under Title I of the Act; or 2 . For purposes of assessing any amount against properties owned and occupied by persons of moderate income, the grantee certifies to the Secretary that it lacks sufficient funds received under section 106 of the Act to comply with the requirements of subparagraph (1) above; (k) Its notification, inspection, testing and abatement procedures concerning lead-based paint will comply with 5570.608; (1) It will comply with the acquisition and relocation requirements of the Uniform Relocation Assistance and Real Property Acquisition .Policies Act of 1970, as amended, as required under 5570.606 (b) and Federal implementing regulations; and the requirements in 5570.606 (c) governing the residential antidisplacement and relocation assistance plan under section 104 (d) of the Act (including a certification that the grantee is following such a plan) ; and the relocation requirements of 5570 .606 (d) governing optional relocation assistance under section 105 (a) (11) of the Act; 9/92 J (m) It has adopted and is enforcing: 1. A policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and 2 . A policy of enforcing applicable State and local laws against physically barring entrance to or exit from a facility or location which is the subject of such non- violent civil rights demonstrations within its jurisdiction; (n) To the best of its knowledge and belief: 1. No Federal appropriated funds have been paid or will be paid, by or on behalf of it, to any person for influencing or attempting to influence an officer or employee of any agency a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any Federal contract, the making of any Federal grant, the making of any Federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any Federal contract, grant, loan, or cooperative agreement; 2. If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with this Federal contract, grant, loan, or cooperative agreement, it will complete and submit Standard Form-LLL, °Disclosure Form to Report Lobbying, in accordance with its instructions; and 3 . It will require that the language of paragraph (n) of this certification be included in the award documents for all subawards at all tiers (including subcontracts, subgrants, and contracts under grants, loans, and cooperative agreements) and that all subrecipients shall certify and disclose accordingly; (o) It will or will continue to provide a drug-free workplace by: 1. publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the grantee' s workplace and specifying the 9/92 actions that will be taken against employees for violation of such prohibition; 2 . Establishing an ongoing drug-free awareness program to inform employees about - (a) The dangers of drug abuse in the workplace; (b) The grantee' s policy of maintaining a drug-free workplace; (c) Any available drug counseling, rehabilitation, and employee assistance programs; and (d) The penalties that may be imposed upon employees for drug abuse violation occurring in the workplace; 3 . Making it a requirement that each employee to be engaged in the performance of the grant be given a copy of the statement required by paragraph 1; 4. Notifying the employee in the statement required by paragraph 1 that, as a condition of employment under the grant, the employee will - (a) Abide by the terms of the statement; and (b) Notify the employer in writing of his or her conviction for a violation of a criminal drug statute occurring in the workplace no later than five calendar days after such conviction; 5. Notifying the agency in writing, within ten calendar days after receiving notice under subparagraph 4 (b) from an employee or 'otherwise receiving actual notice of such conviction. Employers of convicted employees must provide notice, including position title, to every grant officer or other designee on whose grant activity the convicted employee was working, unless the Federal agency has designated a central point for the receipt of such notices. Notice shall include the identification number(s) of each affected grant; 6. Taking one of the following actions, within 30 calendar days of receiving notice under subparagraph 4 (b) , with respect to any employee who is so convicted - (a) Taking appropriate personnel action against such an employee, up to and including termination, 9/92 consistent with the requirements of the Rehabilitation Act of 1973, as amended; or (b) Requiring such employee to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State, or local health, law enforcement, or other appropriate agency; 7 .
