CC Resolution No. 1215 2347 RESOLUTION NO. 1215 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING ADDITIONAL TIME TO MAKE A FINAL DETERMINATION REGARDING THE SCHEDULE OF BASIC CABLE RATES SUBMITTED BY TCI CABLEVISION OF TEXAS, INC. ; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, TCI Cablevision of Texas, Inc. ("TCI") has a franchise agreement with the City of Baytown for the purpose of receiving, sending, amplifying, and distributing radio and television signals by cable to television sets to customers in that portion of Harris County, Texas, which falls within the city limits of the City of Baytown; and WHEREAS, on January 27 , 1994 , the City of Baytown in Ordinance Number 6909 adopted regulations regarding rates charged by cable companies to subscribers for the basic service tier; and WHEREAS, TCI submitted on May 31, 1994 , its current basic cable rate schedule as being in compliance with the Federal Communication Commission's ("FCC") reasonable rate standard; and WHEREAS, Ordinance Number 6909 requires the City Council to perform a benchmark analysis in order to ensure that TCI's rates are within the reasonable rate standards of the FCC and allows council to invoke additional periods of time in order to make a final determination regarding the reasonableness of the submitted rates; and WHEREAS, the City Council desires additional time in order to review the rates using the FCC-proscribed benchmark analysis and to make a final determination to ensure that the rates are within the reasonable rate standard; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The period for review of TCI's current basic cable rate schedule is hereby extended for ninety (90) days.
