RESOLUTION NO. 1212
A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR
MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE
7TH OF MAY, 1994, FOR THE PURPOSE OF ELECTING A MAYOR AT
LARGE AND THREE COUNCILMEMBERS FROM THE RESPECTIVE THREE
DISTRICTS 4 , 5 AND 6; DECLARING THE RESULTS OF SAID
ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS
PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER
OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF
TEXAS.

WHEREAS, pursuant to Chapter 67 of the Texas Election Code,
the City Council of said City, at a council meeting held on the
12th day of May, 1994, proceeded, as required by law, to canvass
the returns of the Regular Municipal Election held in the City of
Baytown on the 7th day of May, 1994, for the purpose of electing a
mayor at large and three councilmembers from the respective three
Districts 4, 5, and 6; said Election having been held under and
pursuant to the provisions of the Charter of said City, and the
Order of the Court in Campos, et al vs. City of Baytown, et al,
and an Ordinance duly passed on the 19th day of February, 1994,
calling said Election; and
WHEREAS, said election having been duly and regularly had and
held as called for in said Ordinance and according to law, and the
returns thereof having been duly made and the Election Judges
having certified the results of said Election, as hereinafter set
out, and the City Council having duly and regularly canvassed the
returns of said Election and finding that the total votes cast at
said Election were as follows, to-wit:
FOR MAYOR
Rolland J. Pruett 893 votes
Pete C. Alfaro 1,481 votes
FOR COUNCILMAN DISTRICT NO. 4
E. Frank Hinds 406 votes
FOR COUNCILMAN DISTRICT NO. 5
David Byford 276 votes
FOR COUNCILMAN DISTRICT NO. 6
Stephen H. DonCarlos 420 votes
B.F. Hewitt 127 votes
AND WHEREAS, the City Council of the City of Baytown finds the
Election returns set out above to be accurate and correct and no
Election protest or contest having been filed with said Council or
instituted in connection with said Election returns; NOW THEREFORE

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Pete C. Alfaro received a majority of the
votes cast at said Election for the office of Mayor, and
accordingly, the said Pete C. Alfaro is hereby declared elected to
the office of Mayor.
Section 2: That E. Frank Hinds received a majority of the
votes cast at said Election for the office of Councilman from
District No. 4, and accordingly, the said E. Frank Hinds is hereby
declared elected to the office of Councilman from District No. 4.
Section 3 : That David Byford received a majority of the votes
cast at said Election for the office of Councilman from District
No. 5, and accordingly, the said David Byford is hereby declared
elected to the office of Councilman from District No. 5.
Section 4 : That Stephen H. DonCarlos received a majority of
the votes cast at said Election for the office of Councilman
District No. 6, and accordingly, the said Stephen H. DonCarlos is
hereby declared elected to the office of Councilman from District
No. 6.
Section 5: That the City Council of the City of Baytown
further finds that the notice of said Election was duly and
properly given as required by law and as provided in the Ordinance
calling said Election and that said Election was duly and regularly
held and the returns thereof duly and regularly made by the proper
officials of said Election and in all things according to law.
Section 6: This resolution shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 12th day of May,
1994.
