CC Resolution No. 1211 2340 RESOLUTION NO. 1211 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING ADDITIONAL TIME TO MAKE A FINAL DETERMINATION REGARDING THE COST-OF-SERVICE SHOWING SUBMITTED BY STAR CABLE ASSOCIATES; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Star Cable Associates has a franchise agreement with the City of Baytown for the purpose of receiving, sending, amplifying, and distributing radio and television signals by cable to television sets to customers in that portion of Chambers County, Texas, which falls within the city limits of the City of Baytown; and WHEREAS, on January 27, 1994, the City of Baytown in Ordinance Number 6909 adopted regulations regarding rates charged by cable companies to subscribers for the basic service tier; and WHEREAS, Star Cable submitted a cost-of-service showing to justify its initial basic cable rate above the Federal Communications Commission's ("FCC") reasonable rate standard; and WHEREAS, the Federal Communications Commission ("FCC") did not have any guidelines for cost-of-service showings prior to its recent Order issued on March 30, 1994; and WHEREAS, Ordinance Number 6909 requires the City Council to review a cost-of-service submission pursuant to FCC standards for cost-of-service review and allows council to invoke additional periods of time in order to make a final determination regarding the reasonableness of the proposed rates; and WHEREAS, the City Council desires additional time in light of the recent guidelines established by the FCC; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The period for review of Star Cable Associates' cost-of-service showing is hereby extended for one hundred fifty (150) days.
