RESOLUTION NO. 1196
A RESOLUTION OF THE CITY OF BAYTOWN, TEXAS, HEREINAFTER
REFERRED TO AS "SPONSOR, " DESIGNATING CERTAIN OFFICIALS
AS BEING RESPONSIBLE FOR, ACTING FOR, AND ON BEHALF OF
THE SPONSOR IN DEALING WITH THE TEXAS PARKS AND WILDLIFE
DEPARTMENT, HEREINAFTER REFERRED TO AS "DEPARTMENT, " FOR
THE PURPOSE OF PARTICIPATING IN THE GRANT PROGRAMS;
CERTIFYING THAT THE SPONSOR IS ELIGIBLE TO RECEIVE
ASSISTANCE UNDER SUCH PROGRAMS; AUTHORIZING APPLICATION
TO THE DEPARTMENT; AND DEDICATING THE PROPOSED SITE FOR
OUTDOOR RECREATION USES; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the City of Baytown, hereinafter referred to as
"Sponsor, " is desirous of providing for the construction of a boat
ramp facility on Goose Creek Stream at Bayland Park; and
WHEREAS, the Texas Parks and Wildlife Department, hereinafter
referred to as "Department, " under the authority of Chapter 11. 033
and 31. 141 of the Parks and Wildlife Code, would provide for such
construction; and
WHEREAS, the construction of such a facility would be of
benefit to the citizens of Baytown as well as transient boaters
from the State and other states; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council in meeting this 9th day of
December, 1993 , is hereby eligible for assistance and will enter
into a project agreement with the Department to provide for said
construction on a reimbursement basis, with the Sponsor providing
25% by appropriations or in-kind services, and the Department
providing 75% matching funds for work accomplished.
Section 2 : That the Sponsor hereby authorizes and directs its
City Manager or his designee to act for the Sponsor in dealing with
the Department for the purpose of these programs, and the City
Manager or his designee is hereby officially designated as the
representative in this regard.
Section 3 : That the Sponsor will operate said facility;
perform all necessary maintenance and repairs to ensure public use,
health and safety; and provide security surveillance to eliminate
creations of nuisance or hazard to the public or adjacent property
owners; for a period of 25 years.
Section 4 : That said facility will be open at all reasonable
times to the public, and that at no time will fees be charged for
use of any supported facilities.

Section 5: That the project area, as defined in the Project
Agreement is hereby dedicated for public outdoor use in perpetuity.
Section 6: This resolution shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown this the 9th day of December,
1993 .
