RESOLUTION NO. 1192
A RESOLUTION DENYING THE APPLICATION FOR THE ISSUANCE OF
A TAXICAB PERMIT OF ROBERT KAPPLER; DIRECTING THE CITY
CLERK TO IMMEDIATELY GIVE NOTICE TO THE APPLICANT OF THE
ACTION OF THE CITY COUNCIL; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, Robert Kappler made application in writing to the
City Council of the City of Baytown for a taxicab permit on
September 14 , 1993 ; and
WHEREAS, the City Council held a public hearing on October 14,
1993 , to consider whether the demands of public convenience and
necessity require such proposed taxicabs within the City; and
WHEREAS, the City Council, in determining whether public
convenience and necessity required the services of the proposed
taxicabs within the City, considered the financial responsibility
of the applicant; the number, kind and type of equipment to be
used; the increased traffic congestion on the streets of the City
which might result; whether the safe use of the streets by the
public, both vehicular and pedestrian, will be preserved by the
granting of such additional permits; and such other relevant facts
as the City Council deemed advisable or necessary; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council finds from the investigation
and hearing that public convenience and necessity will not be
served by the operation of the proposed taxicabs over the streets
of the City of Baytown.
Section 2 : That the City Clerk of the City of Baytown is
hereby directed to immediately give notice to the applicant, Robert
Kappler, of the action of the City Council.
Section 3 : This resolution shall take effect immediately from
and after its passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED, by the affirmative vote of the
City Council of the City of Baytown, this the 28th day of October,
1993 .
