CC Resolution No. 1175 2258 RESOLUTION NO. 1175 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, EXPRESSING APPROVAL AND SUPPORT OF HOUSE BILL 706 RENAMING, RESTRUCTURING AND ALLOCATING GRANT FUNDS TO THE TEXAS RECREATION AND PARKS FUND FOR LOCAL USE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************** WHEREAS, heretofore, the Texas Local Parks, Recreation and Open Space Fund was created by the Texas Legislature for the purpose of providing grant funds to local governmental units such as the City of Baytown, Texas, to afford public parks, recreation facilities and recreational tourism resources in local communities statewide; and WHEREAS, the Texas Legislature has reallocated the entirety of the Fund's cigarette tax revenues from the Fund to the State General Revenue Fund; and WHEREAS, State Representative Oliveira has filed, for consideration and' passage by the Texas Legislature currently in session and for approval by the Honorable Governor of Texas, House Bill No. 706, a bill to be entitled An Act Relating to the Creation of, the Allocation of Revenue to, and the Uses of the Texas Recreation and Parks Fund, Including the Dedication of Revenue from the Sale Tax on Sporting Goods; and WHEREAS, said House Bill No. 706 does not create any new taxes on the citizens of the State of Texas but reallocates taxes presently subject to collection under the State Tax Code; and WHEREAS, the continued and increased availability of grant funds from the Fund for said intended purposes is critical to the future of local Texas communities statewide generally and of the City of Baytown, Texas, specifically; and WHEREAS, said House Bill No. 706 renames the Texas Local Parks, Recreation and Open Space Fund to thereafter be the Texas Recreation and Parks Fund and the same is referred to in this resolution as "the Fund" ; and WHEREAS, the City Council of the City of Baytown, Texas supports and endorses said House Bill No. 706 in its present proposed form and desires to express and publish such support and endorsement; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council hereby respectfully requests the Honorable State Legislature of the State of Texas currently in session to enact into law said House Bill No. 706 in its present proposed form and respectfully requests the Honorable Governor of the State of Texas to approve such enactment. 2259 Section 2: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
