CC Resolution No. 1165 2153 RESOLUTION NO. 1165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DEACTIVATING THE BAYTOWN VOLUNTEER FIRE DEPARTMENT, CANCELLING ANY AGREEMENTS WITH ANY BAYTOWN VOLUNTEER FIREFIGHTERS STATIONS, AND REQUIRING THE RETURN TO THE CITY OF BAYTOWN OF ANY CITY EQUIPMENT AND/OR FUNDS CURRENTLY IN THE POSSESSION OF VOLUNTEER FIREFIGHTERS AND/OR THE BAYTOWN VOLUNTEER FIRE DEPARTMENT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, the City of Baytown wishes to provide the citizens of the City of Baytown the highest level of fire protection and fire suppression possible; and WHEREAS, the City of Baytown provides fire protection to its citizens through a full time paid fire department which meets or exceeds the standards adopted by the Texas Commission on Fire Protection; and WHEREAS, the City of Baytown wishes to comply with all regulations of the Texas Commission on Fire Protection, standards established by the National Fire Protection Association, the Americans with Disabilities Act of 1991 and various state and federal regulations and National Fire Protection Association standards related to the providing of fire protection services to the citizens of the City of Baytown; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Baytown Volunteer Fire Department is hereby deactivated. Section 2: That any agreements with any Baytown volunteer firefighters stations are hereby cancelled. Section 3 : That all firefighter supplies, equipment, clothing or protective gear which the City of Baytown has provided to volunteers for provided funding or the purchase of, be returned to the Baytown Fire Department. Section 4 : That the City of Baytown contact the State Firefighters Pension Commissioners ' office to insure that members of the Baytown Volunteer Fire Department who have vested retirement benefits not lose those vested retirement benefits.
