CC Resolution No. 1147 2064 RESOLUTION NO. 1147 A RESOLUTION CANVASSING THE RETURNS OF THE REGULAR MUNICIPAL ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 2ND OF- MAY, 1992 , FOR THE PURPOSE OF ELECTING A MAYOR FROM THE CITY AT LARGE, AND SIX COUNCILMEN FROM THE RESPECTIVE SIX DISTRICTS; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. ***************************************************************** WHEREAS, pursuant to Chapter 67 of the Texas Election Code, the City Council of said City, at a special meeting held on the 7th day of May, 1992 , proceeded, as required by law, to canvass the returns of the Regular Municipal Election held in the City of Baytown on the 2nd day of May, 1992, for the purpose of electing a Mayor from the City at large and six Councilmen from the respective six districts; said Election having been held under and pursuant to the provisions of the Charter of said City and an Ordinance duly passed on the 13th day of February, 1992 , calling said Election; and WHEREAS, said election having been duly and regularly had and held as called for in said Ordinance and according to law, and the returns thereof having been duly made and the Election Judges having certified the results of said Election, as hereinafter set out , and the City Council having duly and regularly canvassed the returns of said Election and finding that the total votes cast at said Election were as follows, to-wit: FOR MAYOR (FROM CITY AT LARGE) Emmett O. Hutto 1, 645 votes David French 121 votes Bobby J. Credille 3 , 143 votes FOR COUNCILMAN DISTRICT NO. 1 Eva Benavides 350 votes Mario Delgado 234 votes FOR COUNCILMAN DISTRICT NO. 2 Rolland Pruett 307 votes Rocky Rodriguez 181 votes FOR COUNCILMAN DISTRICT NO. 3 Jackson Lawrence 290 votes Ray J. Wilson 259 votes Ray Swofford 307 votes 2065 FOR COUNCILMAN DISTRICT NO. 4 Pete Alfaro 799 votes FOR COUNCILMAN DISTRICT NO. 5 Don M. Hullum 607 votes FOR COUNCILMAN DISTRICT NO. 6 Stephen DonCarlos 411 votes Coleman Godwin 361 votes Norman Ponder 159 votes Guy M. Anderson 272 votes AND WHEREAS, the City Council of the City of Baytown finds the Election returns set out above to be accurate and correct and no Election protest or contest having been filed with said Council or instituted in connection with said Election returns ; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Bobby J. Credille received a majority of the votes cast at said Election for the office of Mayor, and accordingly, the said Bobby J. Credille is hereby declared elected to the office of Mayor. Section 2 : That Eva Benavides received a majority of the votes cast at said Election for the office of Councilman from District No. 1, and accordingly, the said Eva Benavides is hereby declared elected to the office of Councilman from District No. 1. Section 3 : That Rolland J. Pruett received a majority of the votes cast at said Election for the office of Councilman from District No. 2 , and accordingly, the said Rolland J. Pruett is hereby declared elected to the office of Councilman from District No. 2 . Section 4 : That Pete Alfaro received a majority of the votes cast at said Election for the office of Councilman from District No. 4 , and accordingly, the said Pete Alfaro is hereby declared elected to the office of Councilman from District No. 4. Section 5: That Don M. Hullum received a majority of the votes cast at said Election for the office of Councilman from District No . 5 , and accordingly, the said Don M . Hullum is hereby declared elected to the office of Councilman from District No. 5. Section 6 : That no candidate received a majority of the votes cast at said Election for the office of Councilman District - 2 - 2066 No. 3, and accordingly, pursuant to Article IX, Section 94 of the Charter of the City of Baytown, it is necessary that a Run- off Election be held to elect a Councilman for District No. 3 and that the two eligible candidates receiving the highest number of votes for the office of Councilman for District No. 3 are Jackson Lawrence and Ray Swofford; it is therefore ORDERED that a Special Run-off Election be held between the two eligible candidates receiving the highest number of votes at said Election for the purpose of electing one of such candidates to said office. Section 7 : That no candidate received a majority of the votes cast at said Election for the office of Councilman District No. 6, and accordingly, pursuant to Article IX, Section 94 of the Charter of the City of Baytown, it is necessary that a Run- off Election be held to elect a Councilman for District No. 6 and that the two eligible candidates receiving the highest number of votes for the ofice of Councilman for District No. 6 are Stephen DonCarlos and Coleman Godwin; it is therefore ORDERED that a Special Run-off Election be held between the two eligible candidates receiving the highest number of votes at said Election for the purpose of electing one of such candidates to said office. Section 8 : That the City Council of the City of Baytown further finds that the notice of said Election was duly and properly given as required by law and as provided in the Ordinance calling said Election and that said Election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said Election and in all things according to law. Section 9: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
