Ordinance No. 14,425ORDINANCE NO. 14,425 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AN EMERGENCY EXPENDITURE AS AN AMENDMENT TO THE FISCAL YEAR 2019-20 BUDGET DUE TO UNFORESEEN EXPENDITURES NECESSITATED BY THE COVID-19 PANDEMIC; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ******************************************************************************************** WHEREAS, the Governor, the County Judge and the Mayor have issued a disaster proclamation certifying under the Texas Disaster Declaration Act of 1979 that the novel coronavirus (COVID-19) poses an imminent threat of disaster for their respective jurisdictions, including the City of Baytown; and WHEREAS, such declarations have been renewed and are in effect as of this date; and WHEREAS, the social -distancing and stay-at-home orders aimed at protecting the health and safety of the public and ensuring an effective response to this disaster have caused the City of Baytown to incur some unusual and unforeseen expenditures that could not have been included in the original budget through the use of reasonably diligent thought and attention; and WHEREAS, the City of Baytown has incurred expenses necessary (i) to maintain its investment in its valuable public assets, including, but not limited to, its aquatics infrastructure, (ii) to protect its workforce and its citizens, and (iii) to fully staff the City's emergency responders; and WHEREAS, the City Council finds that this amendment of the City's Fiscal Year 2019-2020 is necessary and appropriate given the grave public necessity resulting from the COVID-19 pandemic; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That all matters and facts set forth in the recitals hereinabove are found to be true and such recitals are hereby approved and made a part of this ordinance for all purposes and are adopted as a part of the judgment and findings by the City Council of the City of Baytown, Texas. Section 2: That due to the COVID-19 pandemic, the City Council of the City of Baytown hereby authorizes the emergency expenditures as an amendment to the Fiscal Year 2019-20 Budget as detailed in Exhibit "A," which is attached hereto and incorporated herein for all intents and purposes. Section 3: That the City Clerk is hereby directed to attach a copy of this ordinance amending the Fiscal Year 2019-20 Budget to the original budget and to file a true copy of this budget amendment in the office of the County Clerk of Harris and Chambers Counties. Section 4: This ordinance shall be and remain in full force and effect from and after its passage and approval of the City Council, and it shall be published once each week for two (2) consecutive weeks in the official newspaper of the City of Baytown.
