Ordinance No. 12,197ORDINANCE NO. 12,197 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GRANTING A VARIANCE TO SECTION 22 -124 OF THE CODE OF ORDINANCES, BAYTOWN, TEXAS, TO EXTEND THE TEMPORARY HOUSING PERMIT AT 517 S. BURNET DR., BAVTOWN, HARRIS COUNTY, TEXAS, UNTIL DECEMBER 31, 2013; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Section 22 -124 of the Code of Ordinances of the City of Baytown, Texas (the "Code ") allows the Chief Building Official to issue a temporary structure permit for the temporary placement of an approved manufactured home or recreational vehicle on property during rehabilitation or reconstruction of the single- family dwelling unit, regardless of zoning district requirements, if (i) the single - family dwelling unit became uninhabitable due to a disaster, and (ii) the Chief Building Official determines that the single - family dwelling unit is uninhabitable and the permit request satisfies all requirements of the ordinance and other applicable regulations; and WHEREAS, the temporary structure permit has a term of six months, which can be extended for another six months by the Chief Building Official; and WHEREAS, the City Council can extend the permit again for an additional six -month term based upon the Chief Building Official's assessment that the permit holder is unable to complete the reconstruction set forth under the permit due to circumstances beyond the permit holder's control such as, but not limited to, a local shortage of building materials or properly licensed contractors; and WHEREAS, the Code does not provide for any further extensions beyond this P/z year period; and WHEREAS, Mr. Ward has requested and was granted a variance to temporary structure permit regulations to allow his permit to be extended until December 31, 2012, which should have been enough time for Mr. Ward with assistance from the Harris County Recovery Program to complete the construction and move back into his house; and WHEREAS, Mr. Ward's structure remains incomplete; and WHEREAS, Mr. Ward has requested another variance to temporary structure permit regulations to allow his permit to be extended until December 31, 2013, which should be enough time for Mr. Ward with assistance from the Harris Countv Recovery Program to complete the construction and move back into his house; and WHEREAS, the Chief Building Official has reviewed this request for an extension and believes, based on the information submitted by Mr_ Ward, that Mr. Ward has been unable to complete the reconstruction of his dwelling due to circumstances beyond his control; NOW THEREFORE, 13E IT MUMMA) BY"IVE CITY COUNCIL OF `H IF, CITY OFBAYTOWNATAAS: section 1: "Ibal all maucrs and kwis so NO in the recitals above are tbund to 1w true and correct.
