WHEREAS, Deer Park Lumber Company, LTD, was awarded the Anneal Construction Materials
Contract on December 13, 2007, pursuant to competitive bidding procedures, which contract include(] an
option by the parties to renew for additional one-year periods„ and
WHEREAS, such contract was renewed on November 13, 2008, November 12, 2009, and October 25,
2010, and can be renewed again for an additional one-year term; and
WHEREAS, Deer Park Lumber Company, I.,td, has indicated its willingness tat renew the contract for
an additional year under the same terms and conditions with a 15%, markup based upon the Random Lengths
Price Guide for all lumber costs; and
WHEREAS, the Administration has reviewed the market conditions and reconiniends renewal as being
in the best interest of the City; NOW THEREI'-'01�1`

Section 1: 'I"hat the City COLITICil ofthe City ofMaytown hereby renews the Annual ConstrUCti011
Materials Contract Nvith Deer Park Lumber Company, LTD, for an additional one-year period.
Section 2: That the City Council of the City of Baytown hereby authorizes payment in an arnOLInt
not to exceed SEVENTY-I° IVETI IOUSAND AND NO1 00 DOLLARS (575,000.00) to Deer [lark Lumber
Company, LTD, for the Annual Construction Materials Contract.
Section 3: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of. FIFTY THOUSAND AND NO/100 DOLLA16 ($50,000.00) or less,
subject to the provision that the original contract price may not be increased by more than twenty-five percent
(25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to SUCII
decrease.
Section 4- ']'his ordinance shall take effect in,unediately froni aqd aller its passage by the City
Council of the City ot'Baytown.
