Ordinance No. 11,802ORDINANCE NO.11,802 ' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, MAKING CERTAIN FINDINGS;PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN,TEXAS,AND THE ANNEXATION OF APPROXIMATELY 283 ACRES OWNED BY LS ENERGY PROPERTIES,LLC,US DENRO STEELS,INC.,CEDAR CROSSING LP,NSN PROPERTIES LLC,AND UNITED STATES STEEL CORPORATION BEING OUT OF THE W.D.SMITH SURVEY,ABSTRACT NO.23 AND JOHN IJAMS SURVEY, ABSTRACT NO.15 LOCATED EAST OF FM1405 AND APPROXIMATELY 4,000 FEET SOUTH OF E.MCKINNEY ROAD IN CHAMBERS COUNTY,TEXAS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS FOR THE CITY OF BAYTOWN,TEXAS. ************************************************************************************* WHEREAS,therebeingnorequestforan"on-site"hearing,twopublichearingsbeforetheCity Council of theCity of Baytown,Texas,whereallinterestedpersonswereprovidedwithanopportunityto beheardontheproposedannexation of thepropertydescribedinSection1ofthisordinance,wereheld, during the City Council meetings on the 27*day of October,2011,and on the Is1 day of November,2011, intheCityCouncilChamber of theCityHalloftheCity of Baytown,Texas,whichdatesarenotmore thanforty(40)norlessthantwenty(20)dayspriortotheinstitution of annexationproceedings;and WHEREAS,notices of thefirstandsecondpublichearingswerepublishedinanewspaperhaving general circulation in the City of Baytown,Texas,and in the below described territories on the 16lh day of October,2011,and onthe 20*day of October,2011,respectively,which dates are not more than twenty (20)norlessthanten (10)dayspriortothedate of suchpublichearings;and WHEREAS,notice of thefirstpublichearingwaspostedontheCity of Baytown's noticeboard andwebsiteonthe14thday of October,2011,andnotice of thesecondpublichearingwaspostedonthe City of Baytown'snoticeboardandwebsiteonOctober 21,2011,whichdatesarenotmorethantwenty (20)norlessthanten(10)dayspriortothedates of thepublichearings;and WHEREAS,eachnoticepostedontheCity of Baytown's noticeboardandwebsiteremained posteduntilthedate of the hearing referencedinthenotice;and WHEREAS,thetotalcorporatearea of theCity of Baytown,Texas,onthe1stday of January, 2011,was37.61squaremiles;and WHEREAS,thepopulation of theCity of Baytown,Texas,isapproximately71,802inhabitants; and WHEREAS,the below described territories liewithinthe extraterritorial jurisdiction of theCity of Baytown,Texas;and WHEREAS,thebelowdescribedterritorieslieadjacenttoandadjointheCity of Baytown, Texas;NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That the following described landand territories lying adjacent toand adjoining theCity of BaytownareherebyaddedandannexedtotheCity of Baytown,Texas,andshallhereinafter beincludedwithinthe boundary limits of theCity of Baytown,Texas,and present boundarylimits of suchCity,atthe various points contiguous totheareas hereinafter described,are altered and amended so asto include said areas within the corporate limits of theCity of Baytown,Texas,to-wit: SEE EXHIBIT "A" Section2:Theabovedescribedterritoriesandtheareassoannexedshallbeapart of the City of Baytown,Texas,andthepropertysoaddedherebyshallbearitsprorata of thetaxesleviedbythe City of Baytown,Texas,andtheinhabitants thereof shallbe entitled toall of therightsand privileges of allthe citizens of theCity of Baytownandshallbeboundbytheacts,ordinances,resolutions,and regulations of theCity of Baytown,Texas.
