AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown is a member of the cooperative purchasing program established Under
Sections 271.082 and 271.083 of the Texas Local Government Code; and
WHEREAS, the `Texas Local Government Purchasing Cooperative's Buy Board Program is such a program,
allowing rininicipalitics to purchase products and/or services in all efficient, cost effective, and competitive
procurement method; and
WHEREAS, the City of Baytown in making a I)LIrchase under a state contract through such cooperative
purchasing prograrn satisfies state law requiring municipalities to seek competitive bids for the purchase ofthe item;
NOW TfIEREFORE
BE IT ORDAINED BY'"ITH., CITY COUNCIL OF TI-11"ary OF BAY'l`OWN,TEXAS:
Section 1: That the City Council 017 the City Of Baytown hereby authorizes the payment of I
ONE HUNDREI) NINETY-SIX AND O3/1 00 DOLLARS ($57,196.03) toT.F. Harper and
Associates, L.P., for the purchase and installation ol'a roof over the basketball court at N.C. Foote Park through the
Texas Local Government Purchasing Cooperative (Buy Board) Sllbtject to terms and conditions acceptable to the City
Manager and City Attorney.
Section 2: That the City Manager is hereby granted general authority to approve any change order
involving a decrease or all increase in costs of FIFTYT1 IOUSAND AND NCl/I00 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25%) or decreased by
more than twenty-five percent (25%) without the consent ofthe contractor to such decrease.
Section 3: '['his ordinance shall take effect inilnediately from and after its passage by the City Council of'
the City of` Baytown.
