Ordinance No. 11,754ORDINANCE NO. 11,754 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RENEWING THE AGREEMENT WITH AS &G CLAIMS ADMINISTRATION, INC., AS THE THIRD PARTY ADMINISTRATOR FOR THE ADMINISTRATION OF THE CITY'S WORKERS' COMPENSATION PROGRAM; AUTHORIZING PAYMENT IN AN AMOUNT NOT TO EXCEED TWENTY -FIVE THOUSAND AND NO /100 DOLLARS ($25,000.00) FOR THE SERVICES ASSOCIATED WITH THE CITY'S WORKERS' COMPENSATION PROGRAM; AUTHORIZING THE ACQUISITION FROM MIDWEST EMPLOYERS CASUALTY COMPANY OF THE CITY'S EXCESS WORKERS' COMPENSATION INSURANCE; AUTHORIZING PAYMENT IN THE AMOUNT OF FIFTY -THREE THOUSAND AND NO /100 DOLLARS ($53,000.00) FOR THE EXCESS WORKERS' COMPENSATION INSURANCE PROGRAM; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby renews its agreement with AS &G Claims Administration, Inc., as the third party administrator for the administration of the City's Workers' Compensation Program on behalf of the City of Baytown. Section 2: That the City Council of the City of Baytown authorizes payment to AS &G Claims Administration, Inc., in an amount not to exceed TWENTY -FIVE THOUSAND AND N0 1100 DOLLARS ($25,000.00), pursuant to the agreement authorized in Section 1 hereof. Section 3: That for the third party administrator services as described in Sections 1 and 2 hereinabove, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less; however, the original contract price may not be increased by more than twenty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without the consent of the contractor to such decrease. Section 4: That the City Council of the City of Baytown, Texas, hereby authorizes the City Manager to acquire from Midwest Employers Casualty Company the City's Excess Workers' Compensation Insurance. Section 5: That the City Council of the City of Baytown authorizes payment to Midwest Employers Casualty Company in an amount of FIFTY -THREE THOUSAND AND NO 1100 DOLLARS ($53,000.00) for the services associated with the City's Excess Workers' Compensation Insurance Program, pursuant to the purchase authorized in Section 4 hereof. Section 6: That for the third party administrator services as described in Sections 4 and 5 hereinabove, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY THOUSAND AND NO/100 DOLLARS ($50,000.00) or less; however, the original contract price may, not be increased by more than twenty-five percent (25%) or decreased by more than twenty-five percent (25%) without the consent of the contractor to such decrease.
