Ordinance No. 11,720ORDINANCE NO.11,720 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND ENTER INTO A JOINT ELECTION AGREEMENT WITH HARRIS COUNTY FOR THE SPECIAL ELECTION TO BE HELD ON THE 8TII DAY OF NOVEMBER,2011,UNDER TERMS AND CONDITIONS ACCEPTABLE TO THE CITY MANAGER AND THE CITY ATTORNEY;AUTHORIZING PAYMENT THEREFOR IN AN AMOUNT NOT TO EXCEED FORTY THOUSAND AND NO/100 DOLLARS ($40,000.00);AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ************************************************************ WHEREAS,theCity of Baytown isholdingitsspecialelectionon November 8,2011,forthepurpose of reauthorizingthelocalsalesandusetaxintheCityof Baytown attherate of one-fourth of onepercenttocontinue providingrevenuefor maintenance andrepair of municipalstreets;and WHEREAS,HarrisCounty(the "County")isholdinganelectiononthesameuniformelectiondate;and WHEREAS,theCityandtheCountydesiretoholdjointelectionsintheelectionprecinctsthatcanbe served by common polling places;and WHEREAS,pursuanttoSection 271.002 oftheTexasElectionCode,theterms ofthejointelection include theCityagreeingtopayaportion of theCounty'selectioncostsinexchangefortheCounty: r-providingthevotingequipmentandsuppliesforearlyvotingbypersonalappearanceandmailandfor election day; 'r-providing election workers; ">-setting upthe polling places; >serving astheEarlyVotingBallotBoard; >programmingandoperatingtheautomatictabulatingequipment;and >establishing and organizing theCentralCountingStation;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:ThattheCityCounciloftheCityof Baytown.Texas,herebyauthorizestheCityManagerto negotiate and enter into a joint election agreement with Harris County for the special election to be held on the 8'day ofNovember,2011,undertermsandconditionsacceptabletotheCityManagerandtheCity Attorney. Section2:ThattheCityCouncil oftheCity of Baytown,Texas,authorizespaymenttoHarrisCountyin an amount notto exceed FORTY THOUSAND AND NO/100 DOLLARS ($40,000.00),pursuant tothe agreement identified in Section 1 hereof. Section 3:This ordinance shall take effect immediately from and afterjts passage by the City Council of theCity of Baytown.
