Ordinance No. 11,711ORDINANCE NO. 11,711 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RENEWING THE CONTRACTS OF JMB TIRE AND APPLIANCE COMPANY AND FULLERS TIRE COMPANY, INC., FOR THE ANNUAL TIRE AND TUBE CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF ONE HUNDRED NINE THOUSAND THREE HUNDRED EIGHTY -ONE AND 30/100 DOLLARS ($109,381.30); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, JMB Tire and Appliance Company and Fullers Tire Company, Inc., were each awarded the Annual Tire and Tube Contract on September 8, 2005, pursuant to competitive bidding procedures, which contract included an option by the parties to renew for additional one -year periods; and WHEREAS, such contract was renewed on August 24, 2006, August 9, 2007, August 28, 2008, August 13, 2009, and July 22, 2010, and can be renewed again for an additional one -year term; and WHEREAS, JMB Tire and Appliance Company and Fullers Tire Company, Inc., have each indicated its willingness to renew the contract for an additional year under the same terms and conditions; and WHEREAS, the Administration has reviewed the market conditions and recommends renewal as being in the best interest of the City; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby renews the contract of JMB Tire and Appliance Company for Sections I, IV and VI of the Annual Tire and Tube Contract for the sum of SEVENTY -SEVEN THOUSAND TWO HUNDRED THIRTY -SEVEN AND 57/100 DOLLARS ($77,237.57) and authorizes payment thereof. Section 2: The amount authorized in Section 1 includes a 25% increase to the original contract to allow for the fluctuation in usage and pricing in the market, which was authorized under the original contract and/or renewal thereof. Section 3: That the City Council of the City of Baytown hereby renews the contract of Fullers Tire Company, Inc., for Sections II and III of the Annual Tire and Tube Contract for the sum of THIRTY -TWO THOUSAND ONE HUNDRED FORTY -THREE AND 73/100 DOLLARS ($32,143.73) and authorizes payment thereof. Section 4: The amount authorized in Section 3 includes a 25% increase to the original contract to allow for the fluctuation in usage and pricing in the market, which was authorized under the original contract and/or renewal thereof. Section 5: This ordinance shall take effect immediately from and aller its passage by the City Council of the City of Baytown.
