WHEREAS, copper Nvifing has been stolen from the highway lighting; system oil 1-10 between I'M 2100 to
Highway 146; and
WHEREAS, Texas I..,ocal Government Code Annotated §252.022 provides that it' a PrOCUrenient is

WHEREAS, the purchase and installation of wiring is a procurement necessary not only for the public
health and safety but also due to the unforeseen darnage to public property caused by the aforementioned copper
theft; NOW THEREFORE

Section I. That the City Council of the City of Baytown, Texas, hereby finds that (lie recitals
contained liereinabove are true and correct and are the findings of the City Council of the City ofBaytown,'texas.
Section 2: That the City Council of the City of Baytown, Texas, authorizes a contract with Republic
intelligent Transportation Services, Inc.,, for the replacement and installation of wiring; for the highway lighting
systern along I- 10 in the amount of ONE HUNDRED FORTY-FOI-J RTI IOUSAND FOUR HUNDRED NINE"FY-
FIVE AND NO/100 DOLLARS ($144,495.00).
Section 3: That pursuant to the Provisions of"I'exas Local Government Code Annotated § 252,048,
the City Manager is hereby granted general authority to approve any change order involving a decrease or all
increase in costs of—TWENTY-FIVE T] 10L)SAND AND NO/100 DOLLARS ($25,000.00) or less, subJect to the
provision that the original contract price may not be increased by more than twenty-five percent (25%) or decreased
by more than twenty-live percent (25%) without the consent of the contractor to such decrease.
