AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO
EXECUTE AND ATTEST TO A CONTRACT WITH MONTGOMERY
BUILDING SERVICES,LLC,FOR THE CITY HALL SOUTH RENOVATION
PROJECT;AUTHORIZING PAYMENT OF A SUM OF FIVE HUNDRED THIRTY-
NINE THOUSAND TWO HUNDRED AND NO/100 DOLLARS ($539,200.00);
AUTHORIZING MAKING OTHER PROVISIONS RELATED THERETO;AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS,theCityCouncil of theCity of Baytowndid advertise forbidsfortheCityHall
SouthRenovationProjecttobereceivedonMarch9,2011;and
WHEREAS,noticetobiddersas lo the timeandplace,whenandwherethebids would be
publicly openedandreadaloudwaspublishedpursuantto provisions of Texas Local Government Code
Annotated §252.041;and
WHEREAS,allbidswereopenedandpubliclyreadatCityHallat2:00o'clockp.m.,Wednesday,
March 9,2011,as per published notice to bidders;NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1:ThattheCityCouncil of theCity of Baytown hereby accepts thebid of
Montgomery Building Services,LLC,fortheCity Hall South Renovation Project according totheplans
and specifications setforthbythe City's consultant and authorizes payment of an amount of FIVE
HUNDRED THIRTY-NINE THOUSAND TWO HUNDRED AND NO/100 DOLLARS ($539,200.00);
baseduponthelumpsum and/or unitpricesspecifiedinthebid,andtheCity Manager andtheCityClerk
of the City are hereby authorized and directed to execute and attest toa contract with Montgomery
Building Services,LLC,forthe above-described project,said contract containing theplans,
specifications,and requirements of the City's consultant and appropriate bond requirements in accordance
withthe provisions of Texas Government Code,Chapter 2253.
Section 2:That pursuant to the provisions of Texas Local Government Code Annotated
§252.048,theCity Manager isherebygrantedgeneralauthorityto approve any change order involving a
decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO/100 DOLLARS
($25,000.00)orless,subject tothe provision thattheoriginal contract pricemaynotbe increased bymore
than twenty-five percent (25%)or decreased bymorethan twenty-five percent (25%)withoutthe consent
of the contractor to such decrease.
Section3:Thisordinanceshalltakeeffectimmediatelyfrom and^aftcr itspassagebythe
CityCouncil of theCity of Baytown.
