Ordinance No. 11,587ORDINANCE NO. 11,587 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING ORDINANCE NO. 10,850 PRESCRIBING THE NUMBER OF POSITIONS IN THE CLASSIFICATION "SERVICE GROUP — POLICE" TO CHANGE THE NAME OF THE CLASSIFICATION IMMEDIATELY BELOW THE CHIEF OF POLICE; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, the City Council of the City of Baytown desires to change the name of the classification immediately below the Chief of Police from "Captain" to Assistant Chief without modifying the number of positions in the ranks in the Classification "Service Group — Police "; and WHEREAS, changing the name of the classification immediately below the Chief of Police is designed to allow for greater efficiency in the department's interactions with other agencies; and WHEREAS, Section 143.021(a) of the Texas Local Government Code requires that the City Council by ordinance prescribe the classifications of all police officers by ordinance; and WHEREAS, the City Council last prescribed the classifications of all police officers and the the number of positions in each classification of the Police Department on March 13, 2008, via Ordinance No. 10,850 as follows: Chiefof Police ................................................... ..............................1 Captain............................................................... ..............................3 (In accordance with Chapter 143 of the Texas Local Government Code, 2 appointed captain positions and 1 tested captain position) Lieutenant...................................... ..............................8 Sergeant......................................... .............................15 Patrol Officer ..... ............................... ............................120 WHEREAS, the City Council now desires to amend a classification in "Service Group — Police" to change the name of the classification immediately below the Chief of Police from "Captain" to "Assistant Chief'; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 1 of Ordinance No. 10,850, passed the 13`h day of March, 2008, relating to the number of positions in the Classification "Service Group - Police," is hereby amended to read as follows: That the number of positions in each classification in the police department shall be as follows: Chiefof Police ................................................... ..............................1 AssistantChief .......... - .............. ............. -- ...................... 3 (in accordance with Chapter 143 of (lie Texas Local Government Code, 2 appointed assistant chief positions and I tested assistant chiel' position) Lieutenant ......... ........ ........... ......... ...... ......... 8 Sergeant- —... . ... .......... ....... ............... ........... .15 Patrol Officer................... .... ..... -- ................ ............. 120 Section 2: All ordinances or parts of" ordinances inconsistent with the terms of this ordinance are hereby repealed; provided,, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3. If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of' same to any person or the set of ci rcurn stances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect iturnediately from and after its passage by the City Council of the City of Baytown.
