amended to read as follows:

Sec. 18 -27. Windstorm plan information.
Prior to issuing a permit for new construction, the building official will require a separate
building plan or plans with building sections and details showing the components, their types,
locations, and framing elements that delineate that the framing will resist the pressures developed
from, and the wind speeds in ASCE -7 (120 MPH 3 second gusts).
Section 2: That Chapter 18 "Buildings and Building Regulations," Article II

professional" of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:

Sec. 18 -28. Design professional.
When submittal documents are provided by a registered professional engineer, the design
professional must be a registered licensed professional engineer legally registered or licensed
under the laws of this state regulating the practice of engineering.
(1) The engineer must be knowledgeable in the discipline for which the engineer is
designing.
(2) The practice of engineering in coincidence with enforcement of this code will be
in keeping with the rules regulating the practice of engineering.
(3) The design professional shall affix the design professional's official seal to the
drawings, specifications, and accompanying data determined necessary by the
chief building official, for windstorm requirements.
Section 3: That Chapter 18 "Buildings and Building Regulations," Article II
"Building Construction Standards," Division I "Windstorm Standards," Section 18 -29
"Windstorm resistant construction inspections" of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to read as follows:

Sec. 18 -29. Windstorm resistant construction inspections.
When engineered construction documents are used for permitting, it is the certifying
engineer's responsibility to ensure that the engineer or the engineer's representative has completed
the windstorm framing inspection prior to the city inspector completing the city's final rough
frame inspection.
Section 4: That Chapter 18 "Buildings and Building Regulations," Article Il
"Building Construction Standards," Division 2 "Construction Board of Adjustments and
Appeals," Section 18 -56 "Established; composition; appointment," subsection (a) of the Code of
Ordinances, City of Baytown, Texas, is hereby amended to read as follows:

(a) There is established a board to be called the construction board of adjustments and
appeals, which shall consist of eight members as follows:

Sec. 18 -91. Adopted.
(a) Except as provided in this division, the International Building Code, 2009 edition,
published by the International Code Council, Inc., as amended in section 18 -92 is adopted
and incorporated as fully as if set forth at length in this section and the provisions therein
shall be controlling in the design, construction, quality of materials, erection, installation,
alteration, repair, location, relocation, replacement, addition to, use and maintenance of
buildings and structures within the city limits. The official copy of the building code is
on file in the office of the chief building official.
Section 6: That Chapter 18 "Buildings and Building Regulations," Article If
"Building Construction Standards," Division 3 "Building Code," Section 18 -92 "Amendments"
of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows:

Sec. 18 -92. Amendments.
The building code adopted in section 18 -91 shall be amended as follows:
Section 112 Board of appeals is deleted in its entirety and replaced by division 2 of article I1 of
this chapter of the code of ordinances. All references to board of appeals in the code adopted in
section 18 -91 shall mean and refer to the construction board of adjustment and appeals.
Section 1603.1.4 Wind design data is amended to read as follows:
The following information related to wind loads shall be shown, regardless of
whether wind loads govern the design of the lateral- force - resisting system of the
building:
Basic wind speed (3- second gust) of 120 miles per hour.
2. Wind importance factor, 1, and occupancy category.

3. Wind exposure B or C, if more than one wind exposure is utilized, the
wind exposure and applicable wind direction shall be indicated.
4. The applicable internal pressure coefficient.
Components and cladding. The design wind pressures in terms of psf
(kN /m2) to be used for the design of exterior component and cladding
materials not specifically designed by the registered design professional.
Section 1609.1 Applications is amended to read as follows:
Buildings, structures and parts thereof shall be designed to withstand 120 MPH
@ 3 second gust wind loads prescribed herein. Decreases in wind loads shall not
be made for the effect of shielding by other structures.
Section 1609.3 Basic wind speed is amended as follows:
The basic wind speed, in mph, for the determination of the wind loads shall be
120 MPH. Basic wind speed for the special wind regions indicated, near
mountainous terrain and near gorges shall be in accordance with local
jurisdiction requirements. Basic wind speeds determined by the local jurisdiction
shall be in accordance with Section 6.5.4 of ASCE 7.
Section 1805.3.4 Foundation elevation is amended to read as follows:
On graded sites, not within the designated special flood hazard areas, the top of
any exterior foundation shall extend above the elevation of the crown of the road
a minimum of 18 inches plus or minus 2 percent. Alternate elevations are
permitted subject to the approval of the building official, provided it can be
demonstrated that required drainage to the point of discharge and away from the
structure is provided at all locations on the site. A registered surveyor shall
certify the finished floor elevation to be in compliance with this section. A copy
of such certification shall be presented to the building official prior to issuance of
the certificate of occupancy.
Section 1805.3.4.a. Setback survey shall be added to read as follows:
A registered surveyor shall certify the building setbacks are in compliance with
those established in the code of ordinances. A copy of such certification shall be
presented to the building official prior to placement of foundation concrete.
Section 7: That Chapter 18 "Buildings and Building Regulations," Article 11
"Building Construction Standards," Division 3 `'Building Code," Section 18 -96 "Fire protection
systems" of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:

Sec. 18-96. Fire protection systems.
No vertical building inspections above the foundation are permitted, for any building on
any tract of land within the corporate limits of the city until such time as the water lines, approved
fire vehicle access lanes, and fire hydrants necessary for fire protection have been constructed in a
manner suitable to the fire chief or are already present. Flammable materials may not be
stockpiled on a building site under a foundation permit, and such stockpiling shall be grounds for
revoking a foundation permit.
Section 8: That Chapter 18 "Buildings and Building Regulations," Article II
"Building Construction Standards," Division 4 "Building and Development Permits," Section 18-
126 "Survey or site plan required; access management," Subsection (a) of the Code of
Ordinances, City of Baytown, Texas, is hereby amended to read as follows:

DIVISION 4. BUILDING AND DEVELOPMENT PERMITS
Sec. 18 -126. Survey or site plan required; access management.
(a) Survey or site plan. The construction documents submitted with the application for
permit shall be accompanied by a survey or site plan showing to scale the size and
location of new construction and existing structures on the site, distances from lot lines,
the established street grades, and the proposed finish grades and, as applicable flood
hazard areas, floodways, and design flood elevations; and it shall be drawn in accordance
with an accurate boundary line survey. In the case of demolition, the site plan shall show
construction to be demolished and the location and size of existing structures and
construction that are to remain on the site or plot. The building official is authorized to
waive or modify the requirement for a site plan when the application for permit is for
alteration or repair or when otherwise warranted. In addition, a site plan shall show size
of easements, if any exist, and locations of existing and proposed utilities and drainage
structures and locations and sizes of driveways. Sidewalks must be shown on all site
plans in platted subdivisions. Sidewalk and driveway specifications are available in the
inspections division.
Section 9: That Chapter 18 "Buildings and Building Regulations," Article III
"Electrical Code," Division 6 "Standards," Section 18431 "Compliance with article, electrical
code and utility company specifications," Subsection (a) of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:

ARTICLE III. ELECTRICAL CODE
DIVISION 6. STANDARDS
Sec. 18 -431. Compliance with article, electrical code and utility company specifications.
(a) All electrical construction and all materials and appliances used in connection with the
installation, maintenance and operation of electrical wiring, apparatus or equipment for
the utilization of electrical energy for light, heat or power inside the city limits shall
conform to such special rules and regulations as may be embodied in this article, to the
published rules and regulations of the National Electrical Code, 2011 edition, published
by the National Fire Protection Association, and to the electric public utility company's
meter loop specifications. Evidence that electric equipment is suitably safe to persons and
property is solely based upon Underwriters' Laboratories, Inc., or other nationally
recognized testing institute's approval. The official copy of the electrical code is on file
in the office of the chief building official.
Section 10: That Chapter 18 "Buildings and Building Regulations," Article IV
"Plumbing Code," Section 18 -461 "Adopted," Subsection (a) of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:

ARTICLE IV. PLUMBING CODE
Sec. 18 -461. Adopted.
(a) The International Plumbing Code, 2009 edition, published by the International Code
Council, Inc., as amended in section 18 -462, is adopted as the plumbing code of the city
and is made a part of this article for all intents and purposes The official copy of the
plumbing code is on file in the office of the chief building official.
Section 11: That Chapter 18 "Buildings and Building Regulations," Article IV
"Plumbing Code," Section 18 -462 `'Amendments" of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to read as follows:

ARTICLE IV. PLUMBING CODE
Sec. 18 -462. Amendments.
The plumbing code adopted in section 18 -461 shall be amended as follows:
Section 106.5.3 Expiration is amended to read as follows:
Every permit issued shall become invalid upon the expiration of 180 days after
its issuance unless (i) the work authorized by such permit is commenced and an
inspection is performed by the chief building official within the 180 -day period,
or (ii) the work authorized by such permit is extended by the chief building
official in accordance with this section. The chief building official is authorized
to grant, in writing, one or more extensions of time, for periods not more than
180 days each. The extension shall be requested in writing and justifiable cause
demonstrated.
Section 106.6.2 Fee schedule is amended to read as follows:
The fees for all plumbing work and re- inspections shall be as indicated in section
2 -595 of this code.
Fuel gas piping may be included as part of a plumbing permit when identified on
the permit application.
Section 109 Board of appeals is deleted in its entirety and replaced by division 2 of article II of
chapter 18 of the code of ordinances. All references to board of appeals in the code adopted in
section 18 -461 shall mean and refer to the construction board of adjustment and appeals.
Section 917 Air admittance valves is amended to read as follows:
The air admittance valves shall not be located inside buildings.
Section 12: That Chapter 18 "Buildings and Building Regulations," Article V
"Mechanical Code," Division 3 "Standards," Section 18 -556 "Code adopted," Subsection (a) of
the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows:

Sec. 18 -556. Code adopted.
(a) The International Mechanical Code, 2009 edition, as published by the International Code
Council, Inc., as amended in section 18 -557, is adopted as the mechanical code of the city
and is made a part of this article for all intents and purposes. The official copy of the
mechanical code is on file in the office of the chief building official.
Section 13: That Chapter 18 "Buildings and Building Regulations," Article VI
"International Fuel Gas Code," Division 2 "Standards," Section 18 -622 "Code adopted,"
Subsection (a) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:

"International Fuel Gas Code," Division 2 "Standards," Section 18 -623 "Amendments" of the
Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows:

When gas service has been discontinued to a gas system for any reason the entire
system shall be tested in accordance with section 406, before gas service will be
reconnected.
Section 109 Board of appeals is deleted in its entirety and replaced by division 2 of article II of
chapter 18 of the code of ordinances. All references to board of appeals in the code adopted in
section 18 -622 shall mean and refer to the construction board of adjustment and appeals.
Section 15: That Chapter 18 "Buildings and Building Regulations," Article VII
"International Property Maintenance Code," Division 2 "Standards," Section 18 -625 "Code
adopted," Subsection (a) of the Code of Ordinances, City of Baytown, Texas, is hereby amended
to read as follows:

Baytown, Texas, is hereby amended to read as follows:

Sec. 18 -651. Residential code adopted.
(a) The 2009 edition of the International Residential Code, as amended in section 18 -652, is
adopted and incorporated as fully as if set forth at length in this section and the provisions
therein shall be controlling in the design, construction, quality of materials, erection,
installation, alteration, repair, location, relocation, replacement, addition to, use or
maintenance of one- and two- family dwellings and townhouses in the city. The official
copy of the residential code is on file in the office of the chief building official.
Section 18: That Chapter 18 "Buildings and Building Regulations," Article IX
"Minimum Property Standards," Division 2 "One- and Two - Family Dwellings and Townhouses,"
Section 18 -652 "Amendments to the residential code" of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:

Sec. 18 -652. Amendments to the residential code.
The residential code adopted in section 18 -651 shall be amended as follows:
Section R108.2 Schedule of permit fees is amended to read as follows:
On buildings, structures, electrical, gas, mechanical and plumbing systems or
alterations requiring a permit, a fee for each permit shall be paid as required, in
accordance with the fee schedules established in Chapter 2 of the Code.
Section RI12 Board of Appeals is amended to read as follows:
Section R112 "Board of Appeals" is repealed in its entirety and replaced by
Chapter 18, Article II, Division 2. Any reference to the Board of Appeals in the
code adopted in section 18 -651 shall mean and refer to the Construction Board of
Adjustments and Appeals established in Chapter 18, Article II, Division 2 of this
code.
Section R301.2. I Climatic and geographic design criteria is amended by adding a new subsection
numbered and entitled R301.2.1.5 Windstorm Resistant Construction, which subsection shall read
as follows:
R301.2.1.5 Windstorm Resistant Construction. All new structures within the city
shall be constructed to meet the 120 mph @ 3 second gust requirements of the
division 1, article I, chapter 18 of the city's code of ordinances.
Section 403.1.7.3 Foundation Elevation is amended to read as follows:

Article III of this code, the provision of NFPA 70, the National Electrical Code
and Chapter 18, Article III of the code of ordinances shall take precedence.
Section 19: That Chapter 18 "Buildings and Building Regulations," Article IX.5
"International Existing Building Code," Division 2 "Standards," Section 18 -765 "Adopted,"
Subsection (a) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:

Sec. 18 -765. Adopted.
(a) Except as provided in this division, the International Existing Building Code, 2009
edition, published by the International Code Council, Inc., as amended in section 18 -766,
is adopted and incorporated as fully as if set forth at length in this section and the
provisions therein shall be controlling in the repair, alteration, change of occupancy,
addition and relocation of existing buildings and structures within the city limits. The
official copy of the existing building code is on file in the office of the chief building
official.
Section 20: That Chapter 38 "Fire Prevention and Protection," Article III "Fire
Prevention Standards," Section 38 -61 "Code adopted," Subsection (a) of the Code of Ordinances,
City of Baytown, Texas, is hereby amended to read as follows:

Sec. 38-61. Code adopted.
(a) Except as may otherwise be provided in this chapter, the International Fire Code, 2009
edition, published by the International Code Council, Inc., as amended in section 38 -62,
is adopted and incorporated as fully as if set forth at length in this section. The fire
prevention code adopted in this section shall be controlling within the city limits. One
copy of the code is on file in the office of the fire chief.
Section 21: That Chapter 38 "Fire Prevention and Protection," Article III "Fire
Prevention Standards," Section 38 -62 "Definitions," of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to rename the section as Section 38 -62 "Definitions and amendments,"
which section shall read as follows:
CHAPTER 38. FIRE PREVENTION AND PROTECTION
ARTICLE III. FIRE PREVENTION STANDARDS
Sec. 38-62. Definitions; amendments.
(a) Definitions.
(1) Wherever the term "municipality" is used in the fire prevention code adopted in
section 38 -61, it shall be held to mean the City of Baytown, Texas.
(2) The term "retail service station" means that portion of a property where a
flammable or combustible liquid used as motor fuel is stored and dispensed as an
act of retail sale from fixed equipment into the fuel tank of a motor vehicle. The
term does not include a marina.
(b) Amendments. The fire prevention code adopted in section 38 -61 is hereby amended, in
part, as follows:
Section 307.1 shall be amended to read as follows:
A person shall not start or authorize to start any open burning within the
city limits except as approved in writing, in advance by the local fire
code official or if required or mandated by state law. Requirements of
Section 307.2.1 shall be followed and the local fire code official shall
approve the burn site prior to ignition.
Section 503.2.3 Surface is amended to read as follows:
Fire apparatus access roads shall be constructed of asphalt or concrete.
Other approved hard, all- weather surface materials may be used with
written approval by the fire chief. Fire apparatus access roads shall be
constructed and maintained so as to withstand the load of fire apparatus,

without failure, during all types of weather and during all phases of
construction.
Section 508.5.1 Where required is amended to read as follows:
Where a portion of the facility or building constructed hereinafter or
moved into or within the city is more than 300 feet from a hydrant on a
fire apparatus access road, as measured by an approved route around the
exterior of the facility or building, on -site fire h) drants and mains shall
be provided where required by the fire code official.
Exceptions:
1. For Group R -3, including 1 & 2 family dwellings, and Group U
occupancies, the distance required shall be 500 feet.
2. For buildings equipped throughout with an approved automatic
sprinkler system installed in accordance with Section 903.3.1.1
or 903.3.1.2, the distance requirement shal I be 500 feet.
Section 903.3.6 Hose threads is amended to read as follows:
Fire hose threads and standpipes used in connection with automatic
sprinkler systems shall be approved by the fire code official and shall be
compatible with fire department hose threads.
903.3.6.1 A 5" (5 inch) Storz connection, with locking caps
manufactured by the Knox Company, shall be used for all fire
department connections where a NFPA 13 (commercial) sprinkler system
or any standpipe system is installed.
903.3.6.2 A 2'/2" (2' /z inch) National Standard Threads female
connection, with locking caps manufactured by the Knox Company, may
shall be used for fire department connections where a NFPA 13D or 13R
sprinkler system is installed in multi - family dwellings.
Section 907.10.1.1 Public & Common Areas is amended to read as follows:
Visible alarm notification appliances shall be provided in all public areas
and all common areas. "Public areas" constitutes areas that are accessible
to the general public. "Common areas" constitutes areas that may be
shared by two or more persons at the same time (i.e. shared offices,
meeting rooms, conference rooms, break rooms, restrooms, storage
rooms over 100 square feet that are accessible from corridors or open
work areas to which access is not restricted, etc.).
Section 912. I Installation is amended to read as follows:
912.1 The type, size and location of fire department connections shall be
approved by the fire code official.

Section 912.2 Location is amended to add the subsections which shall read as
follows:
912.2.2 Where NFPA 13 sprinkler systems or standpipe systems are
installed, the fire department connection shall be located remote of the
building, out of the collapse zone. The collapse none is a distance away
from the building at least equal to the height of the exterior wall of the
building, on the side of the fire department connection.
912.2.3 The remote fire department connections shall be at a 45- degree
downward angle to the ground and shall be at least 24 inches from the
ground and no higher than 36 inches from the ground.
912.2.4 All fire department connections shall be located:
a) no more than 50 feet from fire department access;
b) no more than 100 feet from an accessible fire hydrant;
and
C) on the same side of the driveway /roadway as the
accessible fire hydrant, so as not to block the
driveway /roadway with fire hose, when applicable.
( Section 912.5. FDC requirements for multi- family dwellings:
a) Baytown Fire Department requirements for NFPA 13R sprinkler
systems on multi - family dwellings, (3 stories or less, only):
b) Wall mounted 2 '/z inch fire department connection (FDC) is
required to have a locking cap manufactured by the Knox
Company.
c) All FDC's shall be unobstructed (bushes, fence, etc.) and plainly
visible from the fire department access road.
d) All fire department connections shall be located no more than
50' (feet) from the fire department access road and no more than
100' (feet) from an accessible fire hydrant.
e) A posted locator sign shall identifj, all fire department
connections.
f) The locator sign shall be approximately 8" X 18".
g) The locator sign will have a RED background with reflective
WHITE lettering.
h) Text shall be - 6" letters (FDC).

i) The locator sign shall be mounted above the fire department
connection, high enough so that it is not obstructed by bushes,
fencing, vehicles, etc. and clearly visible from the fire
department access road.
Section 912.2.5 Access is amended to include:
When barriers such as, but not limited to, ditches or fences are present,
then access points shall be provided to maintain the 50 foot travel
distance between the fire department connection and the fire department
access road. Access points may consist of a gate or pathway, at grade, at
least 4 feet wide.
Section 912.4 Signs is amended to read as follows:
912.4 A posted sign, in accordance with the fire code official's
requirements, must identify all fire department connections.
912.4.1 Number and type of sign required One header sign is required
for buildings that have one address, one sprinkler system, and one fire
department connection. Header and locator signs are required for
buildings that have multiple addresses, multiple sprinkler systems, or
multiple fire department connections.
912.4.2 Requirements of a header sign. A header sign must be clearly
visible and must:
be metal with square corners;
2. be 18" x 24" in size;
3. be mounted 8 to 10 feet above grade and centered on the
fire department connection;
4. have a red background with reflective white lettering;
and
5. contain the following verbiage:
a. "F.D.C." in 6 -inch lettering on the first line of
the sign;
b. "Sprinkler," "Standpipe," and/or "Test
Connection," as appropriate, in 3 -inch lettering
on the second line of the sign;
C. the street number of the address of the structure
in 4 -inch lettering on the third line of the sign;
and

d. The street name in 3 -inch high lettering on the
fourth line of the sign.
912.4.3 Requirements of a locator sign. A locator sign must be clearly
visible on the exterior of all commercial buildings and must:
1. be metal with square corners;
2. be 18" x 24" in size;
3. be mounted 12 inches above the individual fire
department connection;
4. have a white background with reflective red lettering;
5. designate what areas are serviced by the corresponding
fire department connection; and
6. contain the following:
a. "F.D.C." in 6" lettering on the first line of the
sign; and
b. type of connection and area served in 3"
lettering.
912.4.4 Existing Buildings. All owners of existing buildings within the
city containing a NFPA 13 or 13R sprinkler system or a standpipe must
comply with the signage requirements contained in this section 912.4 on
or before August 1, 2009.
912.4.5 Sprinkler riser rooms.
All Sprinkler riser rooms /closets shall be identified with a sign on the
door (minimum lettering size is 2 inches).
Section 912.5 Requirements for Backflow protection is amended to include:
When the fire hydrant and the fire department connection (FDC) are on
the main water supply line, there must be a double check backflow
preventer and an OS &Y /PIV valve between the hydrant and the FDC.
Section 1006.1 is amended to include:
Emergency egress lighting shall be required in all public accessible
restrooms that have more than 1 toilet / urinal fixture.
Section 22: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances
regulating and governing the subject matter covered by this ordinance.
