AN ORDINANCE OF THE CITY COUNCIL, CITY OF BAYTOWN, TEXAS,
ACCEPTING THE PRIVATE DRIVE KNOWN AS MISSION VIEJO STREET
AS A CITY RIGHT -OF -WAY IN ACCORDANCE WITH CHAPTER 122
"STREETS AND SIDEWALKS," ARTICLE IV "DEDICATION AND
ACCEPTANCE OF PUBLIC STREETS" OF THE CODE OF ORDINANCES,
BAYTOWN, TEXAS, CONTINGENT UPON A SATISFACTORY TITLE
REPORT OR OPINION AND UPON THE RECEIPT OF A WARRANTY
DEED ACCEPTABLE TO THE CITY MANAGER AND THE CITY
ATTORNEY; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the President of the Homeowners Association of Mission Viejo, Inc.,
submitted a letter on August 9, 2010, requesting that the City accept the private drive known as
Mission Viejo Street as City right -of -way; and
WHEREAS, Chapter 122 "Streets and Sidewalks," Article IV "Dedication and
Acceptance of Public Streets," Baytown Code of Ordinances establishes a uniform procedure for
the dedication and acceptance of public streets that are not dedicated through the recordation of a
subdivision plat; and
WHEREAS, the City Engineer has determined that Mission Viejo Street has been well -
maintained for many years and met the requirements of the City's regulation in effect at the time
of construction in accordance with Section 122 -191 of the Code of Ordinances, Baytown, Texas;
and
WHEREAS, on October 20, 2010, the Planning and Zoning Commission of the City of
Baytown voted to forward a recommendation to City Council to modify the Thoroughfare Plan
by adding Mission Viejo Street as a local street and to accept the private drive as city right -of-
way without conditions; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the private
drive known as Mission Viejo Street as a city right -of -way in accordance with Chapter 122
"Streets and Sidewalks," Article IV "Dedication and Acceptance of Public Streets" of the Code
of Ordinances, Baytown, Texas, contingent upon a satisfactory title report or opinion and upon
the receipt of a warranty deed acceptable to the City Manager and the City Attorney.
Section 2: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
