EIGHTEEN AND NO /100 DOLLARS ($3.089.418.00), which brings the total contract amount
to - 1 -WELVE MILLION FIFTY -NINE THOUSAND FOUR HUNDRED SIXTY -FOUR AND

AMENDMENT NO. 1 TO

CDBG DISASTER RECOVERY ENTITLEMENT GRANT PROGRAM

SECTION 1
The Texas Department of Rural Affairs, an agency of the State of Texas, hereinafter referred to
as "TDRA ", and the City of Baytown, hereinafter referred to as "Grantee ", do hereby contract
and agree to amend their original executed contract, as initially executed by the Executive
Director of TDRA effective March 5, 2010 for the performance of disaster recovery activities.
SECTION 2
The parties hereto agree to amend the contract identified in Section I above by deleting in its
entirety SECTION 4, CONTRACT AMOUNT, and replacing it with the following:
SECTION 4. CONTRACT AMOUNT
Notwithstanding any other provision of this Contract, the total of all payments and other
obligations incurred by TDRA under this Contract shall not exceed the sum of Twelve
Million Fifty -Nine Thousand Four Hundred Sixty-Four Dollars ($12,059,464) reflecting
the total allocation of disaster recovery funds to Grantee.
SECTION 3
The parties hereto agree to amend the contract identified in Section 1 above by deleting in its
entirety Exhibit A, Performance Statement, and replacing it with the Performance Statement that
is attached to this amendment as Exhibit A, and hereby made a part of the contract. Exhibit A
consists of seven (7) pages.
SECTION 4
The parties hereto agree to amend the contract identified in Section 1 above by deleting in its
entirety Exhibit B, the Budget, and replacing it with the Budget that is attached to this
amendment as Exhibit B, and hereby made a part of the contract. Exhibit B consists of three (3)
pages.

The parties hereto agree to amend the contract identified in Section 1 above by deleting in its
entirety Exhibit E, Project Implementation Schedule, and replacing it with revised Exhibit E that
is attached hereto and made a part of this contract. Exhibit E consists of six (6) pages.
SECTION 6
The parties hereto agree that this amendment shall become effective on the date of signature of
this amendment by TDRA.
SECTION 7
The parties hereto agree that all of the terms of the contract identified in Section 1 above shall
remain in effect and shall continue to govern except to the extent that they conflict with the terms
of this amendment.
SECTION 8
The parties hereto agree that nothing in this amendment shall be construed as authorizing any
violation of federal. state or local laws or regulations as they pertain to the contract identified in
Section 1 above.
SECTION 9
By the signing of this amendment, the parties hereto expressly understand and agree that this
amendment shall become a part of the contract identified above in Section 1 above as though it
were set forth word for word therein.

PERFORMANCE STATEMENT
City of Baytown
Grantee shall carry out the following activities in the target area identified in its 2008 Texas CDBG
Disaster Recovery Supplemental Grant application to aid areas most impacted and distressed by
Hurricanes Ike or Dolly. The persons to benefit from the activities described in this Performance
Statement trust be receiving service or a benefit from the use of the new or improved facilities and
activities for the contract obligations to be fulfilled. Grantee shall ensure that the amount of funds
expended for each activity described does not exceed the amount specified for such activity in Exhibit B,
Budget.
As a result of Hurricane Ike on September 13, 2008, the city's water plant, wastewater treatment plant,
lift stations, fire station, police substation, and medical facility failed to function. The failure to function
was due to loss of normal electrical power service for several days, and severe wind damage from
hurricane winds. The failure of these facilities to function threatened the public health, safety, and
welfare of all served by these facilities due to lack of a potable water supply, build -up of untreated
sewage, and compromised emergency services. The city is in need of adequately -sized generators that
will serve as a backup power supply to operate these facilities and building screening to protect against
wind and wind -borne debris.
Water Facilities - la
Grantee shall purchase and install three (3) eight hundred kilowatt (800 kW) permanently - affixed, diesel -
fueled generators and one (1) six hundred kilowatt (600 kW) permanently - affixed, diesel - fueled
generator with manual transfer switches and associated appurtenances. At each location, grantee shall
also construct a concrete pad for generator mounting, and perform site work associated with construction.
Construction shall take place at the Baytown Area Water Treatment Plant located at 7419 Thompson
Road. Installation of the backup generators, transfer switches, and associated appurtenances will ensure
continuous operation of the water plant and uninterrupted water service.
These activities shall benefit seventy -six thousand ninety (76,090) persons, of which thirty-five thousand
four hundred thirty -five (3 5,435), or forty -six percent (46 %), are of low to moderate income.

Sewer Facilities -lb
Wastewater Treatment Plants
Grantee shall purchase and install one (1) two thousand five hundred kilowatt (2,500 kW) permanently -
affixed, diesel - fueled generator with automatic transfer switch and associated appurtenances at the Center
District Wastewater Treatment Plant located at 1601 West Main Street. In addition, grantee shall
purchase and install one (1) two thousand five hundred kilowatt (2,500 kW) permanently- affixed, diesel -
fueled generator with automatic transfer switch and associated appurtenances at the East District
Wastewater Treatment Plant located at 3030 Ferry Road. At each location, grantee shall also construct
an elevated slab for generator mounting, and perform site work associated with the construction.
Installation of these backup generators will ensure continuous operation of the wastewater treatment
plants and uninterrupted sewage treatment.
These activities shall benefit seventy -six thousand ninety (76,090) persons, of which thirty -five thousand
four hundred thirty -five (35,435), or forty-six percent (46 %), are of low to moderate income.
Lift stations
Grantee shall purchase and install thirty (36) permanently- affixed, diesel - fueled generators, each with
automatic transfer switches and associated appurtenances. Grantee shall perform site work associated
with the construction. Construction shall take place at the following locations:

approximately three hundred twenty -five square feet (325 s.f.) of storm screens, approximately seven
hundred fifty square feet (750 s.f.) of front bay roll -down doors, approximately seven hundred fifty
square feet (750 s.f.) of Force 12 real bay doors, and approximately four hundred forty-six square feet
(446 s.f.) type two storm screens to harden the fire station. Construction shall take place at the fire
station located at 3311 Massey Tompkins Street. Installation of the building screening and backup
generator will ensure continuous operation of the fire station.
These activities shall benefit twenty-three thousand seven hundred fifteen (23,715) persons, of which
eight thousand seven hundred fifty -two (8,752), or thirty -six percent (36 %), are of low to moderate
income.
Specially Authorized Public Facilities and Improvements -14
Police Substation
Grantee shall purchase and install six (6) accordion shutters of various sizes consisting of approximately
five hundred eighty-three square feet (583 s.f.) to harden this facility. Construction shall take place at the
police substation located at 3200 North Main Street. Installation of the building screening will protect
against wind and wind -bome debris and ensure continuous operation of the police substation.
These activities shall benefit twenty-two thousand eight hundred ninety -one (22,891) persons, of which
eight thousand six hundred fifty -eight (8,658), or thrity -seven percent (37 %). are of low to moderate
income.
Cit 1
Grantee shall purchase and install two (2) accordion shutters of various sizes consisting of approximately
two hundred one square feet (201 s.f.) and approximately one hundred sixty square feet (160 s.f.) of
screen protection to harden this facility. Construction shall take place at the City Jail located at 3120
North Main Street. Installation of the building screening will protect against wind and wend -borne debris
and ensure continuous operation of the jail to provide crime protection and public safety throughout the
city.
These activities shall benefit seventy -six thousand ninety (76,090) persons, of which thirty -five thousand
four hundred thirty -five (35,435), or forty -six percent (46 %), are of low to moderate income.
Baytown Emergency Medical Service (EMS) Facility
Grantee shall purchase and install approximately forty-two square feet (42 s.f.) of accordion shutters,
approximately two hundred eighty-seven square feet (287 s.f) of storm screens, and approximately four
hundred seventeen square feet (417 s.f.) of roll -down protective doors to harden this medical facility.
Grantee shall purchase and install one (1) forty-five kilowatt (45 kW) permanently - affixed, diesel - fueled
generator with automatic transfer switch and associated appurtenances. Grantee shall construct a
concrete pad for generator mounting, and perform site work associated with construction. Construction
shall take place at the Baytown Emergency Medical Service (EMS) Facility located at 109 South Main
Street. Installation of the building screening and backup generator will ensure continuous operation of
the medical facility.

These activities shall benefit thirty -four thousand one hundred seventy (34,170) persons, of which
nineteen thousand eight hundred fifty -three (19,853), or fifty -eight percent (58 %), are of low to moderate
income.
Police Substation Main
Grantee shall purchase and install approximately three hundred twenty -two square feet (322 s.f) of storm
screening and approximately three hundred square feet (300 s.f) of accordion shutters. Construction
shall take place at the police substation located at 307 South Main Street. Installation of the building
screening will protect against wind and wind -borne debris and ensure continuous operation of the police
substation.
These activities shal l benefit twenty -three thousand three hundred thirty -one (23,331) persons, of which
twelve thousand five hundred twenty -three (12,523), or fifty three percent (53 %), are of low to moderate
income.
Police Substation - Market Street
Grantee shall purchase and install approximately ninety square feet (90 s.f.) of storm screening and
approximately one hundred sixty -six square feet (166 s.f.) of accordion shutters. Construction shall take
place at the police substation located at 3530 Market Street. Installation of the building screening will
protect against wind and wind -borne debris and ensure continuous operation of the police substation.
These activities shall benefit ten thousand seven hundred thirty (10,730) persons, of which seven
thousand three hundred twenty -one (7,321), or sixty -eight percent (68 %), are of low to moderate income.
Police Substa i - efee
Grantee shall purchase and install approximately one hundred twenty -nine square feet (129 s.f) of
accordion shutters and approximately one thousand three hundred twenty -one square feet (1,321 s.f.) of
storm screening. Construction shall take place at the police substation located at 220 West Defee Street.
Installation of the building screening will protect against wind and wind -borne debris and ensure
continuous operation of the police station.
These activities shall benefit twenty -three thousand three hundred thirty -one (23,331) persons, of which
twelve thousand five hundred twenty -three (12,523), or fifty three percent (53 %), are of low to moderate
income.
Police Substation -Wye
Grantee shall purchase and install approximately ninety- four square feet (95 s.f.) of storm screening and
approximately three hundred thirty -eight square feet (338 s.f.) of accordion shutters. Grantee shall
purchase and install one (1) sixty kilowatt (60 kW) permanently- affixed, diesel - fueled generator with
automatic transfer switch and associated appurtenances. Grantee shall construct a concrete pad for
generator mounting and perform site work associated with construction. Construction shall take place at
the police substation located at 203 Fast Wye Drive. Installation of the building screening and backup
generator will ensure continuous operation of the police station.
These activities shall benefit twenty -two thousand eight hundred ninety -one (22,891) persons, of which
eight thousand six hundred fifty -eight (8,658), or thirty -seven percent (37 %), are of low to moderate
income.
