REGARDING THE PURCHASE OF EMI ERGENCY AM RADIO STATION
REPLACEMENT EQUIPMENT, TO AUTHORIZE AN ADDITIONA -E TWENTY
THOUSAND AND NO /100 DOLLARS ($20,000.00) FORT -I- -IE ADDITION OF A
TRANSMITTER SITE AN -D THE INSTALLATION OF UP TO FIVE (5)
TELEPHONE POLES FOR RADIO ANTENNAE: MAKING OTHER
PROVISIONS RELATED THERETO:_ AND PROVIDING FOR THE EFFECTIVE
DATE TIIEREOF_
WHEREAS_ on March 25. 2010- the City Council approved Ordinance No. 11 _334, which
authorized the purchase of a replacement Emergency AM Radio Station project to replace the system
destroyed by Hurricane Ike; and
WHEREAS, during the coverage study by the vendor, it eras determined that there was
inadequate signal strength in the southeast quadrant of the City by the existing locations; and
WHEREAS_ the Citizens Bond Advisory Council unanimously approved arecon- niendation
to the City Council to increase funds for the project in the amount of TWENTY THOUSAND AND
NO /100 DOLLARS ($20,000.00) for an additional transmitter site and the installation of up to rive
(5) telephone poles for radio antennae: NOW THEREFORE
BE IT ORDANL IED BY THE CITY COUNCIL OF THE CITY OF BAYTONVN, TEXAS:
Section 1: That Section 2 of Ordinance No. 11,334 passed by the City Council of the City
ofBayto%vn, on-March-25. 2010. regarding the purchase of emergency AM radio station replacement
equipment_ is hereby amended to read as follnvvs:
Section 2: That the City Council of the City of Baytown. Texas,
authorizes payment of the sum of SEVENTY -FIVE THOUSAND FOUR
HUNDRED "TWENTY -FIVE AND NO /1 00 DOLLARS ($75,425.00) to In- on-nation
Station Specialists, Inc., as the sole source, for the purchase of emergency AM radio
station replacement equipment.
Section 2: That pursuant to the provisions of Texas Local Govern_nient Code Annotated y
252.048. the City Manager is hereby granted general authority to approve any change order involving
a decrease or an increase in costs of TWENTY -FIVE THOUSAND AND NO /100 DOLLARS
($25,000.00) or less_ subject to the provision that the original contract price may not be increased by
more than tN,venty -five percent (25 %) or decreased by more than twenty -five percent (25 %) without
the consent of the contractor to such decrease_
