AN ORDINANCE OF THE CITY COUNCIL OF THE CiTY OF BAYTOWN. TEXAS.
SETTING A DATE AND PLACE FOR A PUBLIC HEARING ON THE PROPOSED
INITIATIVE ORDINANCE, WHICH AMENDS THE CODE OF ORDINANCES OF THE
CiTY OF BAYTOWN. TEXAS. CHAPTER 94 "TRAFFIC AND VEHICLES"
LIMITING THE USE OF TRAFFIC LAW PHOTO - MONITORING DEVICES; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS. on June 30. 2010, an initiative petition proposing to limit the use of traffic law photo -
monitoring devices was filed with the City Clerk; and
WHEREAS, upon receipt of such petition, the City Clerk in accordance with Section 100 of the
Charter of the City of Baytown. Texas, reviewed each petition paper to determine whether each had a proper
statement of the circulator and whether the petition was signed by a sufficient number of qualified electors:
and
WHEREAS. the City Clerk issued a certificate of insufficiency setting forth the particulars in which
the petition is defective and tendered the same to the City Council on July 22. 2010, which was the first
regular meeting of the City Council after the City Clerk completed her examination of the petition; and
WHEREAS, the City Clerk thereafter at once notified the committee of petitioners of her findings;
and
WHEREAS. the committee of petitioners amended the initiative petition by tiling a supplementary,
petition on July 30, 2010, which is within ten days after the City Clerk sent the notification of insufficiency;
and
Nk'HEREAS, within five (5) days of receipt of the amended petition, the City Clerk examined the
same: and
WHEREAS, the City Clerk issued a certificate of sufficiency and tendered the same to the City
Council on August 12, 2010, which was the first regular meeting of the City Council after the City Clerk
completed her examination of the amended petition: and
WI IEREAS. upon receiving the certification of sufficiency concerning the initiative petition front the
City Clerk, the City Council is required to provide for a public hearing on the proposed initiative ordinance;
NOW THEREFORE.
BE iT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section l: That all matters and facts set forth in the recitals hereinabove are found to be true
and are approved by the City Council of the City of Baytown, "Texas.
Section 2: At its special meeting to be held on the 24 "' day of August, 2010, which commences
at 5:30 p.m., in the Council Chambers of the City Hall of the City of Baytown, located at 2401 Market Street,
Baytown. Texas. the City Council will hold a public hearing giving all interested parties the right to appear
and be heard on the proposed initiative ordinance. which limits the use of traffic law photo - monitoring
devices.
Section 3: The City Clerk of the City of Baytown is hereby authorized and directed to cause
notice of such public hearing to be published once in the newspaper having general circulation in the City not
less than seven (7) days prior to the date of the public hearing.
Section 4: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
