(hereinafter `-BPD "). RECITALS: The Department of Justice Office of Justice Programs awarded funding to Harris County through a grant designed to solve cold cases with DNA; and The Harris County Institute of Forensic Sciences (hereinafter "HCIFS "), contains a multidisciplinary forensic laboratory with the capacity to focus on unsolved homicides, rapes and other violent crimes that require substantial investigative time and effort to submit evidence for DNA or other laboratory testing; and The HCIFS has the capacity and seeks to focus on solving cold cases (in which the lead detective is no longer actively investigating the case). of unsolved homicides, rapes and other violent crimes occurring within its jurisdiction that require substantial investigative time and effort prior to submission of evidence for DNA or other laboratory tests; and The BPD. which is located within the boundaries of Harris County, has identified cases which meet the criteria of cold cases within Harris County jurisdiction that may be solved with DNA. NOW, THEREFORE, and in consideration of the mutual covenants hereinafter contained. IT IS HEREBY AGREED as follows: TERMS: I. Agreement Period and Termination A. The term of this Agreement shall begin on .lune 1. 2010 and end on April 30. 2011 unless terminated in accordance with the provisions contained herein. This Agreement shall be of no force or effect until and unless approved in writing by the HCIFS. B. Notwithstanding any provision to the contrary. either Party may terminate this Agreement at any time without cause upon at least thirty (30) days prior written notice. BPD shall be compensated for services completed as of the effective date of termination as authorized in this C.A. File No. 09GEN Agreement. In the event of premature termination of this Agreement due to a determination by the Department of Justice Office of Justice Programs that grant funds are not being used in an effective or efficient manner to further the grant's purpose or that BPD has failed to comply with the terms of the Cooperative Agreement for the grant, Harris County may discontinue any further payments to BPD and direct BPD to repay to Harris County any grant funds that the Department of Justice Office of Justice Programs has directed Harris County to repay. BPD agrees to repay Harris County within 30 days of receipt of a request for repayment from Harris County. ll. Responsibilities of Baytown Police Department A. Under this Agreement. select employees of BPD that have been approved by FICIFS may engage in the investigation of cold cases that meet the following criteria: 1. The lead detective is no longer actively investigating the case. 2. The case involves an offense such as sexual assault and murder where DNA evidence is typically found and would be expected to be informative to the investigation and resolution of the crime. B. BPD in accordance with the general purposes and objectives of this Agreement and the services to be provided. as stated herein. shall: 1. Provide the necessary staff as agreed upon for the performance of BPD's responsibilities under this Agreement. 2. Accurately utilize all record forms as required by Harris County as set out in this Agreement. 3. Submit reports and other documents required by Barris County as set out in this Agreement. C. BPD agrees to cooperate with HCIFS in maintaining complete compliance with all conditions, limitations. including "special conditions" as that term is defined in the "Cooperative Agreement" detailing the grant award to Harris County from the National Institute of Justice. Department of Justice. Oft-ice of Justice Programs which is attached and incorporated for all purposes to this Interloeal Subgrant Agreement as Exhibit A. Ill. Responsibilities of Harris County / HCIFS A. Harris County shall provide overall management and coordination of the grant from Department of Justice. Office of Justice Programs. and identify administrative and investigative representatives for the program. B. I -ICIFS will coordinate and manage all DNA testing through the director over Forensic Biology and Grant Manager for Solving Cold Cases with DNA. Roger Kahn, or such other person as the HCIFS shall designate as Grant Manager. C.. HCIFS will contribute personnel support in the form of consultation with medical examiner's and physical anthropologists, and will also coordinate DNA testing services and grant management through its Forensic Biology Department, an ASCLD /LAB accredited DNA testing laboratory. as part of their efforts. IV. Reports A. The investigative representative of BPD shall prepare and submit reports on the forms furnished by Harris County. referred to as the "Monthly Case Progress Summary Form" (attached to this Agreement as Exhibit B) on the 28th of every month in order to remain in compliance with this Agreement. The HCIFS may amend the report forms from time to tirne. B. If any monthly case report is not completed to the satisfaction of Harris County through the Grant Manager, the form shall be returned to BPD setting forth the additional information desired. BPD shall resubmit the same with the appropriate changes no later than ten (10) business days subsequent to its return. V. Records A. All investigative activities and travel must receive prior written approval from Grant Manager on the forms furnished by Harris County (attached to the Agreement as Exhibit Q. as may be amended by the I ICIFS from time to time), in order to remain in compliance with this Agreement. Requests for approval shall be submitted to the Grant Manager by the investigative representative for BPD. B. Investigative expenses must be pre- approved by the Grant Manager in writing and must meet Harris County reimbursement policy (attached to the Agreement as Exhibit C). If approved the investigative representative for BPD shall submit a reimbursement request for the month in which the expense was incurred on the forms furnished by Harris County (attached to this Agreement as Exhibit D), as may be amended by the HCIFS from time to time). for those expenditures which were preapproved by the County in order to remain in compliance with this Agreement. C. Each investigator assigned to a case for BPD shall submit a bi- weekly timesheet that includes the hours worked and a summary of activities on the forms furnished by Harris County (attached to this Agreement as Exhibits E and F) in order to remain in compliance with the Agreement. V1. Compensation / Termination of Funds / Budget A. Harris County shall pay BPD for the services under this Agreement up to but not exceeding the sum Of thirty six thousand Dollars ($36.000.00) exclusively from Department of Justice Office of Justice Programs grant funds specifically allocated to discharge any and all liabilities that Harris County may incur. including any and all costs for any and all things or purposes inuring under or out of this Agreement, irrespective of the nature thereof and notwithstanding any word. statement, or thing contained in or inferred from the provisions of this Agreement that might in any light by any person be interpreted to the contrary. BPD further understands and agrees that this Agreement is contingent upon grant funding being made available to Harris County for the term of this Agreement. It is expressly understood and agreed that Harris County has no Harris County fiends available with which to pay its obligations hereunder except grant funds allocated and received by Harris County for the services described herein. Harris County shall not be liable under any circumstances or any interpretations hereof for any costs under this Agreement, until and only to the extent that such grant funds are actually received by Harris County, and certified available for this Agreement by the County Auditor. It shall be the obligation of BPD to assure itself that sufficient funds have been allocated to pay for the services provided. It is further understood that Harris County shall not be obligated to pay for any expenses of BPD under this Agreement that the Department of Justice. or the County Auditor. determines are not subject to payment with grant funds. BPD shall have no right of action against Harris County in the event that Harris County is unable to perform its obligations under this Agreement as a result of the suspension, termination, withdrawal. failure, or lack of sufficient grant funding to Harris County for these services. B. It is expressly understood and agreed by BPD that all compensation to be received by BPD for services rendered under this Agreement is subject to the availability of funds therefore from the Department of Justice Office of Justice Programs pursuant to the grant. It is further expressly understood and agreed that BPD shall reimburse Harris County any stun that Harris County should become required to repay the Department of Justice Office of Justice Programs due to the Justice Department's determination that BPD is not using the funds it receives in an effective and efficient manner to further the Grant Agreement's purpose or is not otherwise using the funds in accordance with the Grant Agreement. C. BPD shall utilize the funds that it receives under this Agreement in accordance with the budget mutually agreed upon by Harris County and BPD. The Agreement shall not deviate from such budget without written consent from the HCIFS or authorized representative of Harris County specifying the changes agreed to. VII. Accounting Procedure BPD's internal financial control shall conform with generally accepted accounting practices, such as may be required by Harris County to meet the requirements of the Department Of Justice Office of Justice Programs. and Texas Law. BPD shall maintain adequate fiscal records and files, to support its activities and expenditures made under the terms of the Agreement. 4 Vill. Independent Contractor It is expressly understood and agreed that BPD is an independent contractor. The employees. servants, agents and representatives of BPD shall in no way be deemed to be and shall not hold themselves out as employees, servants, agents or representatives of Harris County and /or the Ilarris County Institute of Forensic Sciences. In no event shall this Agreement be construed as establishing a partnership or joint venture or similar relationship between the Parties hereto. BPD agrees that it is and shall be liable for its own debts. obligations, acts and omissions, including the payment of all required withholding, social security, and other taxes or benefits. BPD agrees to assure that no participant in the program shall look to Harris County and /or the Harris County Institute of Forensic Sciences for any salaries. insurance, or other benefits whatsoever. The provisions of this Paragraph shall survive expiration or termination of this Agreement regardless of the cause of such termination. IX. Nondiscrimination / Compliance with the Law BPD, as required by law and by Harris County's Equal Opportunity Employment and Nondiscrimination Policy, shall not discriminate on the basis of race, national origin, religion. creed, sex, age. veteran status, or disability in performing any work or service or in any way participating in the Program. BPD shall provide all services to be performed tinder this Agreement in compliance with all applicable Federal. State, and local laws, rules and regulations. X. Compliance with Grant Agreement It is expressly understood and agreed by BPD that this Agreement is subject to the terms and conditions of the Cooperative Agreement which identifies the special conditions of the underlying grant award from the Department of Justice Office of Justice Programs to Harris County. BPD shall comply with all applicable terms and conditions of the Cooperative Agreement. The provisions of this Agreement shall take precedence over the Cooperative Agreement unless a conflict exists between this Agreement and the provisions of the Cooperative Agreement, in which case the provisions of the Cooperative Agreement shall prevail. A conflict, however, shall not be deemed to exist where this Agreement; 1) contains additional provisions not set forth in the in the Cooperative Agreement; 2) restates provisions of the Cooperative Agreement to afford Harris County the same or substantially the same right and privileges in this Agreement as in the Cooperative Agreement; 3) requires BPD to perform duties and/or service in less time than that afforded Harris County in the Cooperative Agreement. A copy of the Cooperative Agreement is attached hereto as Exhibit A. 7 X1. Modification of Agreement Modifications. amendments or waivers of any provision of the Agreement may be made only by the written mutual consent of the parties hereto. X1I. Subcontract or Assignment BPD shall not assign. subcontract. or otherwise transfer any of its duties or obligations under this Subcontract without the prior written approval of I larris County through the Grant Manager, or his designee. X111. Complete Subcontract This Agreement. the Exhibit A attached hereto. and any additional or supplementary documents incorporated herein by specific reference contain all the terms and conditions agreed upon by the parties hereto, and no other agreements, oral or otherwise, regarding the subject matter of this Agreement or any part thereof shall have any validity or bind any of the parties hereto. XIV. NIJ and the Recipient will be guided by the following principles: Responsibility for the day -to -day operations of this project rests with the Recipient in implementation of the Recipient's approved proposal, the Recipient's budget (as approved by OJP and NIJ), and the terms and conditions specified in this award. Responsibility for general oversight and redirection of the project, if necessary, rests with NIJ. in addition to its programmatic reporting requirements, the Recipient agrees to provide necessary information as requested by OJP and NIJ. These information requests may include, but are not limited to specific submissions related to: performance, including measurement of project outputs/outcomes; meeting performance specifications; developmental decision points; changes in project scope or personnel; budget modifications and/or cuordination of related projects. 6. Unless otherwise authorized by NIJ, expenses charged to this award must directly relate to: (a) identification. review, and prioritization of Uniform Crime Report (UCR), Part I Violent Crime "cold cases" (cases for which all significant investigative leads have been exhausted) that have the potential to be solved through DNA analysis; (b) identification, collection, retrieval, or evaluation of biological evidence from such cases that reasonably is expected to contain DNA; or (c) performance of DNA analyses on such biological evidence. (a) Accreditation and Privacy Requirements; CODIS; No Research The Recipient shall ensure that each DNA analysis conducted under this award will be performed either (1) by accredited govemment -owned laboratories, or (2) through an accredited fee- for - service vendor. The accreditation must be by a nonprofit professional association of persons actively involved in forensic science that is nationally recognized within the forensic science community. The laboratory must undergo external audits not less than once every 2 years that demonstrate compliance with the DNA Quality Assurance Standards established by the Director of the FBI. The Recipient shall maintain each DNA analysis conducted under this award, and each stored DNA sample that results from this award, in accordance with the privacy requirements and restrictions on disclosure described in 42 U.S.C. section I4132(b)(3). The Recipient agrees to notify NIJ immediately upon any change in the accreditation status of any of its forensic science laboratories, if applicable. The Recipient shall ensure that all eligible forensic DNA profiles obtained with funding under this award will be entered into the Combined DNA Index System ( CODIS), and, where applicable, uploaded to the National DNA Index System (NDIS). The Recipient shall ensure that none of the funds provided under this award are used for research or.:ratislical projects or activities as defined by 28 CFR Part 22 or for research as defined by 28 CFR Part 46. Any questions concerning this provision should be directed to the NIJ Program Manager for the award (h) Nonsupplanting of State or Local Funds The Recipient shall ensure that Federal funds made available through this award will not supplant State or local funds, but instead will be used to increase the amount of funds that would, in the absence of Federal funds, be available from State or local sources for activities funded through this award. The Recipient agrees to notify NIJ immediately if the Recipient receives new State or local funding for any of the purposes included in the approved application for this award. (c) Data collection The Recipient agrees to cooperate with any assessments, national evaluation efforts, or information or data collection requests, including, but not limited to, the provision of any information required for the assessment or evaluation of any activities within this project. 8. The Recipient shall submit a report within 90 days of the end of the award period that, at a minimum, (1) includes a summary and assessment of the program carried out with the funds made available under this Fiscal Year 2008 award and (2) cites the number of additional violent crime cold cases reviewed for DNA evidence, the number of such cases in which biological evidence still ccisted, the number subjected to DNA analysis, the number that yielded DNA profiles, the number of resulting profiles entered into CODIS, and the number of CODIS hits as a result of the Fiscal Year 2008 award. The Recipient shall ensure that all data and information necessary for the report is collected throughout the award period. The report must be submitted to the Office of Justice Programs, on -line through https: / /Prants.ojp.usdoj.gov /. 9. The recipient agrees to submit quarterly financial status reports to the Office of Justice Programs using Standard Form SF 269A on the Internet at htips: / /grants.ojp.usdoj.gov . These reports shall be submitted on -line not later than 45 days alter the end of each calendar quarter. The final report shall be submitted not later than 90 days following the end of the grant period. The recipient must also itemize and report any of the following attendee (including participants, presenters, speakers) costs that are paid or reimbursed with cooperative agreement funds: 1) meals and incidental expenses (N1 &IE portion of per diem); 2) lodging; 3) transportation tolfrom event location (e.g., common carrier. Privately Owned Vehicle (POV)); and, 4) local transportation (e.g,. rental car, POV) at event location. The Project Director and key program personnel designated in the application shall be replaced only for compelling reasons and with the concurrence of OJP. OJP will not unreasonably withhold concurrence. A basic question is whether personal presence will be necessary for the expense. Any trip must be evaluated as to its purpose. Each travel expense request must be based on the lowest costs available. The sources of funds to be used for travel and training must be clearly stated in the request. Every effort should be made to avoid travel expenses by use of the Internet, video, conference calls, and other electronic means. The Office of Human Resources & Risk Management will assist departments with training needs. Travel & Training Budgets After adoption of the annual budget, Management Services is directed to review with department heads the amounts within their budgets that can be allowed for travel and training. Management Services will keep a log on all travel and training expenses. A report with recommendations on expenses and projections will be presented at Mid -Year Review each September. A proposed order for legislative travel will be presented at a Mid -Year Review that precedes the beginning of a new biennium of the Texas Legislature. Out of Texas No out of Texas travel expense is to be paid from the general fund during the period of March 2010 through September 2010. The subject will be reviewed at the Mid -Year Review n September 2010 to decide if the restriction should continue for the balance of the fiscal year. The policy regarding out of Texas travel will be reviewed at each annual budget process for continuation or modification of the policy that was applied in the previous fiscal period. within Texas Expenses for travel and training within Texas are to be limited to events and meetings that are essential for county business. Use of the Internet, videos, conference calls, publications, and collaboration with other agencies for sessions in the Houston area should replace the need for travel out of Hams County to the extent possible. Limits for Outside U.S. The court's order of August 8, 2006 limiting travel outside of the U.S. will remain in effect. The policy states that no travel funds will be approved for travel outside the United States "except in extraordinary circumstances that involve county business." Annual Requests The court's policy adopted ;March 6, 2007 will remain in effect regarding travel expense requests to cover a fiscal year or a similar extended period for attendance at consistent and on -call rneet,ngs that are expected. In those cases, the department head is to provide on the travel request form an estimate of the number of trips, employees, and projected costs for the period.
