OF TLIE CITY OF BAYTOWN_ TEXAS__ DESIGNATING A PART OF THE AREA LOCATED W1 "1-1 -IIN THE CITY OF BAYTOVVN'S EXTRATERRITORIAL JURISDICTION BE INCLUDED AS PART OF BAYTOWN INDUSTRIAL DISTRICT NO. 1: REPEALING CONFLICTING ORDINANCES: CONTAINING A SAVINGS CLAUSE: AND PROVIDING FOR THE EFFECTIVE DATE THEREOF- WHEREAS, Section 42.044 of the Texas Local Government Code expressly provides for the establishment of industrial districts by municipalities within their extraterritorial jurisdictions, and WHEREAS, the City Council through Ordinance No_ 886 established Baytown Industrial District No_ 1: and WHEREAS, such industrial district was amended via Ordinance Nos. 1586 and 11,281 to include additional areas: and V&TIIEREAS. the City Council desires to amend the boundaries of Baytown Industrial District No. l again in order to include property recently disannexed via Ordinance No. 1 1 _339 and therefore within the extraterritorial jurisdiction of the City of Baytovvrt: and WHEREAS, the City Council believes incltlding such additional property within its extraterritorial _jurisdiction will be for the mutual advantage of industry and the citizens of Baytown: NOVV THER1✓FORL- BE IT ORDAINED BY "THE CI -l-Y COUNCIL OI' -I-HE CITY OI' BAY "I_OWN_ TEXAS: Section 1: That the City Council of the City of Baytown, "Texas, hereby designates the property described in Exhibit '-A," which is located -,within the City of Baytown's extraterritorial jurisdiction and is attached hereto and incorporated herein for all intents and purposes. as a part of BaytoNvn Industrial District No. 1. Section 2: All ordinances or parts of ordinances inconsistent with the tern -is of this ordinance are hereby repealed: provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: if any provisions. section, exception, subsection. paragraph_ sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances. shall for anv reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable_ Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. Being a tract of land containing 1.99 acres, of which 1.5588 acres is the property of Consolidated Chemical Division of Stauffer Chemical Company.
