ARCHITECTURAL PRODUCTS, INC., THROUGH FEDERAL SUPPLY SCHEDULE 84
OF THE UNITED STATE'S GENERAL SERVICES ADMThTISTRATION FOR THE
PURCHASE OF HURRICANE BARRIERS FOR THE FIRE DEPARTMENT; MAKING
OT14ER PROVISIONS RELATED THERETO: AND PROVIDING FOR THE EFFECTIVE
DATE T1 FE- REOF.
WHEREAS, the Local Preparedness Acquisition Act (P.L. 1 10-248) amended the Federal Property
and Administrative Services Act to authorize the use of Federal Supply Schedule 84 contracts by state and
local entities under the GSA Cooperative Purchasing Program: and
WHEREAS, based upon the Act, the City of Baytown qualities as a local government entity and is
qualified to participate in the GSA Cooperative Purchasing Program as an alternate purchasing method
satisfying the City's competitive bidding obligations; and
WHEREAS- the purchase of hurricane barriers for the Fire Department may be purchased by the City
through the Cooperative Purchasing Program of the United State's Gencral Services Administration; NOW
TI-IEREFORE
BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN', TEXAS:
Section 1: -1 -hat the City Council of the City of Baytown hereby authorizes the payment of TWO
HUNDRED TWENTY -SIX THOUSAND TWO HUNDRED SEVEN AND NO /100 DOLLARS
($226,207.00) to Phoenix Architectural Products. Inc.. through the Federal Supply Schedule 84 of the United
State's General Services Administration for the purchase of hurricane barriers for the Fire Department.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs ofTWENTY -FIVE "1- 1- 10USAND AND NO /1 00 DOLLARS ($25,000.00) or
less, provided that the original contract price may not be increased by more than twenty -five percent (25 03/6) or
decreased by more than twenty -five percent (25 %) without the consent of the contractor to such decrease_
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council ofthe City of Baytown. _
