Ordinance No. 11,296ORDINANCE NO. 11,296 AN ORDINANCE OF THE CITY COUTNCIL OF THE CITY OF BAYTOWN, TEXAS, RENEWING THE CONTRACT OF GRANT SMI "1 -I-1 MOWING AND TRUGREEN LANDCARE FOR THE ANNUAL MOWING, EDGING AND TRIMMING SERVICES CONTRACT AND AUTHORIZING PAYMENT BY TILE CITY OF BAYTOWN, -1-HE SUM OF TWO FTUNDRED TEN THOUSAND FIVE HUNDRED NINETY- TI -IREE AND 38/100 DOLLARS ($210,593.38); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Grant Smith Mo« -ing and Trugreen Landcare were awarded the Annual Mowing. Edging and Trimming Services Contract on February 23, 2006. pursuant to competitive bidding procedures, which contract included an option by the parties to renew for additional one -year periods; and WHEREAS, such contract was renewed on February S. 2007, and again on February 147 2008- and February 26. 2009- and can be renewed for an additional one -year term; and WHEREAS, Grant Smith Mowing and Trugreen Landcare have indicated their willingness to renew the contract for an additional year under the same terms and conditions based upon the designated sites; and WHEREAS._ the Administration has reviewed the market conditions and recon-11-1-1cnds renewal as being in the best interest of the City: NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN_ TEXAS: Section 1: That the City Council of the City of Baytown hereby renews the contract of Grant Smith Mowing for Sections 1. 11, 1I1 and V of the Annual Mowing, Edging and "I'rimnning Services Contract for the suns of ONE HUNDRED SEVEN"1_Y -FOUR THOUSAND EIGHT HUNDRED FIFTY -THREE AND 38/100 DOLLARS (S174.853.38)- and authorizes payment thereof_ Section 2: That the City Council of the City of Baytown hereby renews the contract of Trugreen Landcare for Section IV of the Annual Mowing, Edging and Trimming Services Contract for the sum of THIRTY -FIVE THOUSAND SEVEN HUNDRED FOR -l'Y AND NO /100 DOLLARS ($35,740.00), and authorizes pa }ment thereof. Section 3: That pursuant to the provisions of Texas Local Government Code Annotated §252.048. the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of TWENTY -FIVE TI IOUSAND AND N01100 DOLLARS ($25,000.00) or less, provided that the original contract price may not be increased by more than twenty -five percent (25 %) or decreased by more than twenty -five percent (2594o) without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. INTRODUCED.
