AN ORDINANCE OF Tl IE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS,
AUTHORIZING THE PAYMENT OF ONE MILLION ONE HUNDRED NINETY-ONE
THOUSAND TWO HUNDRED AND NO/100 DOLLARS (SI.iyi.200.00)FOR THE
PURCHASE OF TWO (2)QUANTUM PIERCE PUMPER TRUCKS FROM MARTIN
APPARATUS.INC.,THROUGH THE IIOUSTON-GALVESTON AREA COUNCIL:
MAKINGOTHER PROVISIONS RELATED THERETO;AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS,the City Council of the City ofBaytown lias approved an Interlocal Agreement which
authorizes the I louslon-Galveslon Area Council to lakebids for certain items on behalfof the City ofBaytown;
and
WHEREAS,pursuant to such agreement,llie Houston-Galveston Area Council lias taken bids for two
(2)Quantum Pierce Pumper Trucks;NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF Tl IE CITY OF BAYTOWN.TEXAS:
Section 1:That the City Council of the City of Baytown hereby authorizes the payment of ONE
MILLION ONE HUNDRED NINETY-ONE THOUSAND TWO HUNDRED AND NO/lo"o DOLLARS
(SI,191.200.00)to Martin Apparatus,Inc.,through the Houston-Galveston Area Council for the purchase of
(wo (2)Quantum Pierce Pumper Trucks.
Section 2:That pursuant to the provisions of Texas Local Government Code Annotated
§252.048.the City Manager is hereby granted general authority to approve anychange order involving a
decrease or an increase in costs of TWENTY-FIVE THOUSAND AND NO/100 DOLLARS (525,000.00)or
less,provided that the original contract price may not be increased by more than twenty-five percent (25%)or
decreased by more than twenty-five percent (25%)without the consent of (he contractor to such decrease.
Section 3:This ordinance shall take effect immediately from and after its passage by the City
Council of the City ofBaytown.f
