ORDINANCE NO. 11,256
AN ORDINANCE OF TI IE CITY COUNCIL OF THE CITY OF BAYTO\ \'N, TEXAS,
AUI-11ORIZING THE PAYMENT IN THE AMOUNT OF ONE HUNDRED TEN
THOUSAND ONE HUNDRED THIRTY AND NO /100 DOLLARS (5110,130.00) TO
THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY FOR THE
ANNUAL CONSOLIDATED WATER QUALITY FEES FOR THE CITY'S FOUR
\k'ASTEWATER TREATMENT PLANTS: AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, the Texas Commission on Environmental Quality ("TCEQ ") in response to the
Clean Water Act has established a program to assess the quality of the river basins of the State; and
WHEREAS. Senate Bill 818 requires the TCEQ to recover the reasonable cost of the assessment
program from wastewater treatment permit holders and water rights holders; and
WHEREAS, the Consolidated Water Quality Fees are assessed annually each October 31" and
imposed on each person holding a permit tinder the V.T.C.A.. Water Code, §§26.001, el seq.: NO \ \'
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN. TEXAS:
Section 1: That the City Council of the City of Baytown. Texas, hereby authorizes the
payment in the amount of ONE HUNDRED TEN THOUSAND ONE HUNDRED THIRTY AND
NO /100 DOLLARS (S110.130.00) to the Texas Commission oil Environmental Quality for the Annual
Consolidated Water Quality Fees for the City's four Wastewater Treatment Plants.
Section 2: That the City Manager is hereby granted general authority to approve any change
involving a decrease or an increase in amount authorized in Section 1 hereinabove of TWENTY -FIVE
THOUSAND AND NO /100 DOLLARS (525.000.00) or less; however, the original contract price play
not be increased by more than twenty -live percent (25 %) or decreased by more than twenty -five percent
(25 %) without the consent of the Texas Commission on Environmental Quality to such decrease.
Section 3: This ordinance shall take effect immediately from I after its passage by the
City Council of the City of Baytown.
